Abstract
การวิจัยนี้เป็นการศึกษาเชิงพรรณนา มีวัตถุประสงค์เพื่อศึกษาสภาพปัญญาและหาแนวทางการแก้ไขปัญหาขยะจากระบบการขนส่งสินค้าทางทะเล ขยะจากเรือสินค้าระหว่างประเทศและเรือลำเลียง ซึ่งเป็นหนึ่งในสาเหตุของมลพิษทางทะเลแก่เกาะสีชัง ดังนั้นจำเป็นต้องมีการจัดการที่ดี เพื่อผลประโยชน์แห่งชาติทางทะเลของไทยในระยะยาว เพื่อความมั่นคง มั่งคั่ง และยั่งยืน ผลการวิจัยพบว่า 1) สำหรับเรือสินค้าระหว่างประเทศ ผลจากการไม่ได้เข้าเป็นภาคีในอนุสัญญาระหว่างประเทศว่าด้วยการป้องกันมลภาวะจากเรือ ค.ศ.1973 และพิธีสาร ค.ศ. 1978 ภาคผนวกที่ 5 ข้อบังคับเกี่ยวกับการป้องกันมลพิษจากขยะบนเรือ ทำให้ 1.1) ประเทศไทยไม่มีอำนาจในการตรวจเรือและบังคับใช้กฎหมายแก่เรือได้อย่างสมบูรณ์ และการดำเนินการในปัจจุบันพบว่าสิ่งอำนวยความสะดวกในการรองรับของเสียจากเรือสินค้าระหว่างประเทศไม่เพียงพอ 1.2) ประเทศไทยไม่สามารถกำหนดพื้นที่ให้เป็นพื้นที่พิเศษและพื้นที่ทะเลที่มีความอ่อนไหวเฉพาะ ที่จะดำเนินการออกกฎหมาย เพื่อป้องกัน ลด และควบคุมมลพิษจากเรือสินค้าระหว่างประเทศได้ และ 2) สำหรับเรือลำเลียง ประกอบด้วย 2.1) ไม่มีการออกกฎหมายที่บังคับเฉพาะเรือลำเลียง ไม่มีการกำหนดแผนในการจัดการขยะแก่เรือลำเลียง 2.2) สิ่งอำนวยความสะดวกในการรองรับของเสียจากเรือลำเลียงไม่เพียงพอ เนื่องจากกระบวนการจัดการขยะโดยเทศบาลตำบลเกาะสีชัง โดยนำขยะจากเรือลำเลียงไปกำจัดที่ศูนย์กำจัดขยะของเกาะสีชังที่ประสบปัญหาเรื่องขยะตกค้างและก่อมลพิษแก่ชุมชนบนเกาะสีชัง โดยข้อเสนอแนะในการแก้ไขปัญหา ดังนี้ 1) สำหรับเรือสินค้าระหว่างประเทศ ไทยควรเข้าสู่การเป็นภาคีอนุสัญญาระหว่างประเทศว่าด้วยการป้องกันมลภาวะจากเรือ ค.ศ.1973 และพิธีสาร ค.ศ. 1978 ภาคผนวกที่ 5 ข้อบังคับเกี่ยวกับการป้องกันมลพิษจากขยะบนเรือ เพื่อทำให้ 1.1) ประเทศไทยมีกฎหมาย ระเบียบ ข้อบังคับ ที่สามารถดำเนินการบังคับใช้และกำหนดข้อปฏิบัติแก่เรือสินค้าระหว่างประเทศที่เข้ามาเทียบท่า และเพื่อการจัดการเรื่องสิ่งอำนวยความสะดวกเพื่อรองรับของเสียอย่างเพียงพอและมีประสิทธิภาพ 1.2) ทำให้ประเทศมีประกาศอ่าวไทยเป็นพื้นที่พิเศษและพื้นที่ทะเลที่มีความอ่อนไหวเฉพาะ ที่จะทำให้เกิดข้อบังคับพิเศษที่จะช่วยป้องกันมลพิษทางทะเลจากกิจกรรมการใช้ประโยชน์จากทะเล และ 2) สำหรับเรือลำเลียง 2.1) ไทยควรออกกฎหมายข้อบังคับที่บังคับแก่เรือลำเลียงโดยตรง โดยกำหนดให้เรือลำเลียงมีแผนจัดการขยะ เช่น ข้อกฎหมายบังคับแก่บริษัทเจ้าของเรือลำเลียง ให้กองเรือลำเลียงแยกขยะก่อนนำไปกำจัด 2.2) ควรให้องค์กรปกครองส่วนท้องถิ่นมีหน้าที่เพียงลำเลียงขนส่งขยะตามหลักสุขาภิบาล โดยให้หน้าที่การกำจัดขยะเป็นของหน่วยงานที่เกี่ยวข้องแทน และควรนำข้อแนะนำปฏิบัติจากอนุสัญญาระหว่างประเทศว่าด้วยการป้องกันมลภาวะจากเรือ ค.ศ.1973 และพิธีสาร ค.ศ. 1978 ภาคผนวกที่ 5 มาปรับใช้กับกฎหมายภายใน เพื่อบังคับใช้แก่เรือลำเลียงและข้อกำหนดเกี่ยวกับสิ่งอำนวยความสะดวกเพื่อรองรับของเสีย
Other Abstract (Other language abstract of ETD)
The research is descriptive research, the objectives of this research were to study the problems & find the guideline for solves the waste management of Marine garbage from Maritime Industry from the Cargo vessels & Barges in Koh Sichang Anchorage Area. The Vessels generated garbage is harmful to marine pollution. To prevent the marine environment must have good management for the Long term of the stability, Prosperity, and Sustainability of Marine National Interests. The research results found that 1) For Cargoes Vessels, Regarding Thailand not yet ratify for MARPOL Annex 5 as a result; 1.1) Thailand has no authority to inspect and enforce the law to foreign vessels. And No improvement for Internal Laws in sectors involved in the garbage's vessels management systems with insufficient of reception facilities for garbage's vessels 1.2) Thailand cannot identify for the Special Areas and Particularly Sensitive Sea Areas to create laws to prevent, reduce and control pollution from vessels. 2) For Barges; 2.1) No legislation that enforces the barges and No waste management plan for the barges. 2.2) Reception facilities for garbage's barges are insufficient, due to the waste management process by Koh Sichang Municipality by disposing of the barge's garbage on the Garbage Disposal Center of Koh Sichang Sub-district that experiencing polluting to the communities on the Koh Sichang island. The results have guidelines for solving the problems as follows; 1) For Cargoes Vessels, Thailand needs to ratify of the MARPOL73/78 Annex 5; For 1.1) Thailand will have the Laws and the Regulation for enforcing the Cargo vessels and for the management of the reception facilities be efficient. 1.2) To driving The Gulf of Thailand to the Special Areas and Particularly Sensitive Sea Areas for the special regulation enforcement. 2) For Barges; 2.1) Thailand should enact laws that govern direct barges, for example, the regulations for Barges Owner Company to notify to Barge Fleet that separates the garbage before disposal. 2.2) The Local Administrative Organizations should be responsible for the Sanitation Waste Transportation only by giving the Waste disposing responsibility to the related organization instead and Should take the Guidelines from MARPOL-How to do it and Port Reception Facilities to be applied to internal laws for enforcing both of the Barges and the reception facilities for barge's garbage
