Abstract
สารนิพนธ์ฉบับนี้มีวัตถุประสงค์ที่จะศึกษาถึงปัญหาและอุปสรรคต่อการเก็บกู้ทุ่นระเบิดสังหารบุคคลของประเทศไทยภายใต้พันธกรณีของอนุสัญญาออตตาวา โดยเฉพาะการปฏิบัติตามพันธกรณีข้อ 5 ว่าด้วยการทำลายทุ่นระเบิดสังหารบุคคลในพื้นที่ทุ่นระเบิดภายใต้เขตอำนาจหรือการควบคุมของรัฐภาคีภายในกรอบระยะเวลา 10 ปี หลังจากอนุสัญญาดังกล่าวมีผลบังคับใช้ต่อรัฐภาคี โดยจะใช้กรอบทฤษฎีประกอบสร้างนิยม (Constructivism) ในการศึกษาและวิเคราะห์ถึงปัญหาและอุปสรรคต่อการเก็บกู้ทุ่นระเบิดเพื่อมนุษยธรรมของประเทศไทยที่ยังไม่สามารถปฏิบัติได้ตามพันธกรณีในอนุสัญญาออตตาวา ซึ่งจากการศึกษา พบว่า อนุสัญญาที่เผยแพร่บรรทัดฐานที่เน้นมนุษย์ (Human-centric) ขัดต่อบรรทัดฐานที่เน้นรัฐ (State-centric) ที่เคยยึดถือกันมาอย่างยาวนาน ส่งผลให้ระบบการปกครองในแต่ละรัฐบาลของประเทศไทยให้ความสำคัญในเรื่องการเก็บกู้ทุ่นระเบิดไม่เท่ากัน และเกิดความไม่ต่อเนื่องในการปฏิบัติตามบรรทัดฐาน รวมทั้งการไม่มี Norm entrepreneur ภายในประเทศเข้ามาผลักดันประเด็นปัญหานี้ได้อย่างเต็มที่ จึงทำให้การรับเอาบรรทัดฐานเข้ามากลายเป็นเรื่องของการคล้อยตามทางสังคม (Social conformity) ซึ่งอยู่ในระดับรัฐที่มีการยอมรับแบบผิวเผิน และต้องการแสดงให้ประชาคมระหว่างประเทศเห็นว่าตนเองให้ความสำคัญและสามารถปฏิบัติตามบรรทัดฐานนี้ได้ เพื่อผลประโยชน์ทางวัตถุเป็นหลัก นอกจากนี้ยังเกิดความขัดกันของแนวทาง (Contestation) ในการช่วยเหลือของประเทศสหรัฐอเมริกา ในกระบวนการคิดกับวิธีการกวาดล้างทุ่นระเบิดที่ไม่ตรงกับบริบทของประเทศไทย เนื่องจากประเทศไทยมีภูมิประเทศที่แตกต่างจากประเทศฝั่งตะวันตก เช่น พื้นที่สูงชัน ป่ารกทึบ ห่างไกล และยากต่อการเข้าถึง ทั้งนี้ จึงทำให้การปฏิบัติการเก็บกู้ทุ่นระเบิดของประเทศไทยมีประสิทธิภาพน้อย และไม่สามารถปฏิบัติภารกิจให้เสร็จสิ้นได้ภายในกรอบระยะเวลา 10 ปี
Other Abstract (Other language abstract of ETD)
This independent study aims to investigate the problems and impediments to Thailand's humanitarian mine clearance under the Ottawa Convention. In particular, compliance with Article 5 of the obligation to destroy anti-personnel mines in mine areas under the jurisdiction or control of states parties within ten years of the entry into force of this convention for that state party. Using the constructivism theory framework to study and analyze problems and impediments to Thailand's humanitarian mine clearance, which is still unable to meet the Ottawa Convention obligations. According to the study, conventions propagating human-centric norms are in contrast to the long-held norm that emphasizes state-centric norms. As a matter of fact, the governance system in each Thai government has not given equal importance to mine clearance, resulting in a lack of continuity in compliance with the norms, as well as a lack of domestic norm entrepreneurs to fully push this issue. As a consequence, the adoption of norms becomes a matter of social conformity at the state level, with the intention of demonstrating to the international community that value and can comply with this norm for primarily material benefit. There is also a conflict of approaches or contestation in the United States' assistance in the process of thinking and methods for mine clearance that do not fit the Thai context. Because of Thailand's geographical differences with Western countries, such as steep, dense forests, remote, and difficult-to-access areas. As a result, Thailand's demining operations are less effective, and the mission cannot be completed in ten years.
