Abstract

วิทยานิพนธ์ฉบับนี้มุ่งศึกษาปัญหาการใช้น้ำในลุ่มแม่น้ำโขงและแนวทางในการใช้น้ำอย่างสมเหตุสมผลและเป็นธรรมตามความตกลงความร่วมมือเพื่อการพัฒนาที่ยั่งยืนของลุ่มแม่น้ำโขง ค.ศ. 1995 ในการศึกษาพบว่า 1. ปัญหาเกี่ยวกับการใช้น้ำในลุ่มแม่น้ำโขงที่อาจนำไปสู่ความขัดแย้งในอนาคตได้แก่ ผลประโยชน์ในการใช้น้ำที่แตกต่างกันของรัฐริมน้ำ และการที่ความตกลงความร่วมมือเพื่อการพัฒนาที่ยั่งยืนของลุ่มแม่น้ำโขง ค.ศ.1995 นั้น มิได้กำหนดปัจจัยที่ใช้ในการพิจารณาถึงสิทธิการใช้น้ำอย่างเป็นธรรมของรัฐริมน้ำแต่ละฝ่ายไว้อย่างชัดแจ้ง 2. กฎหมายระหว่างประเทศเกี่ยวกับการใช้น้ำแม่น้ำระหว่างประเทศนั้นกำหนดให้รัฐริมน้ำทุกรัฐมีสิทธิใช้น้ำในแม่น้ำระหว่างประเทศที่อยู่ภายในดินแดนของตนอย่างสมเหตุสมผลและเป็นธรรม แต่เนื่องจากกฎหมายระหว่างประเทศไม่สามรถกำหนดได้ว่าการใช้น้ำอย่างไรและในปริมาณเท่าใดจึงจะเป็นการใช้น้ำที่สมเหตุสมผลและเป็นธรรม จึงได้กำหนดปัจจัยที่ใช้ในการพิจารณาไว้ โดยปัจจัยที่ใช้ในการพิจารณาในแม่น้ำแต่ละแห่งจะแตกต่างกันไปตามลักษณะพิเศษของแม่น้ำแต่ละแห่ง และเพื่อให้เกิดความชัดเจนในการใช้น้ำอย่างสมเหตุสมผลและเป็นธรรมของรัฐริมน้ำแต่ละรัฐ รัฐริมน้ำในภูมิภาคต่างๆ จึงได้มีการจัดทำความตกลงเกี่ยวกับการใช้น้ำขึ้น 3. การที่ความตกลงความร่วมมือเพื่อการพัฒนาที่ยั่งยืนของลุ่มแม่น้ำโขง ค.ศ. 1995 มิได้กำหนดปัจจัยที่ใช้ในการพิจารณาถึงการใช้น้ำอย่างสมเหตุสมผลและเป็นธรรมของรัฐภาคีแต่ละฝ่ายไว้อย่างชัดแจ้ง ดังที่เคยปรากฏในตราสารระหว่างประเทศเกี่ยวกับการใช้น้ำในลุ่มแม่น้ำโขงที่มีมาก่อนหน้านี้ เนื่องจากความตกลงฯฉบับนี้ได้กำหนดกระบวนการก่อนการใช้น้ำซึ่งเปิดโอกาสให้รัฐภาคีเข้าสู่การเจรจาและสามารถยกปัจจัยต่างๆ ขึ้นพิจารณาได้หลากหลายกว่าการที่จะกำหนดปัจจัยที่ใช้ในการพิจารณาไว้อย่างตายตัวในความตกลง อันทำให้ความตกลงฉบับนี้มีความยืดหยุ่นสูง แต่ก็อาจก่อให้เกิดข้อขัดข้องได้เนื่องจากรัฐแต่ละรัฐอาจจะหาข้อยุติไม่ได้ว่าจะใช้ปัจจัยใดในการพิจารณา ดังนั้นจึงควรนำเอาปัจจัยหรือเกณฑ์ที่ใช้ในการพิจารณาถึงความเป็นธรรมในการใช้น้ำที่ปรากฏในงานประมวลกฎหมายระหว่างประเทศมาใช้เป็นพื้นฐานในการพิจารณา เพื่อให้เกิดความชัดเจนในการพิจารณาถึงสิทธิการใช้น้ำอย่างสมเหตุสมผลและเป็นธรรมของรัฐภาคีต่อไป

Other Abstract (Other language abstract of ETD)

This thesis intends to study the problems on equitable and reasonable utilization of water in the Mekong Basin under the Agreement on the Cooperation for the Sustainable Development of the Mekong River Basin of 1995. The following issues have come to my perception. 1. Water utilization in the Mekong basin may lead to conflicts of interest in the future i.e. the Agreement on the Cooperation for the Sustainable Development of the Mekong River Basin of 1995 does not specify the factors in determining the right to use water equitably by riparian, states in a clear and concise manner. 2. According to international law, riparian states has right to use water in any international river on reasonable and equitable basis as long as it is done within its boundary. But international remains silent on the scale and the volume of water utilization. It only simply ascertain determination factors for equitable and reasonable utilization of water as basis for negotiation among riparian states concerned. But these factors are diverse, depended on geographical, economical and political circumstances of each international river. 3. Under the 1995 Mekong agreement, the term of reasonable and equitable utilization have not been clearly spelled out. However, this agreement set forth the process of water utilization in the Mekong River system by notification and prior consultation and making specific agreement. However, factors for equitable and reasonable for water utilization enter into process and adopted by riparian states as guidance for determination.
