Abstract

วิทยานิพนธ์ฉบับนี้มีจุดมุ่งหมายเพื่อที่จะหาคำตอบว่า กฎหมายซึ่งมีโทษทางอาญาของไทยที่ใช้บังคับอยู่ในปัจจุบัน สามารถป้องกันและปราบปรามการทุจริตในการใช้บัตรเครดิตบนอินเตอร์เนทซึ่งเป็นการกระทำความผิดต่อข้อมูลบัตรเครดิตของผู้อื่นโดยอาศัยเทคโนโลยีสารสนเทศได้หรือไม่ โดยใช้วิธีการวิจัยเอกสารในการดำเนินการ ผลการวิจัยพบว่า ปัจจุบันประเทศไทยยังไม่มีกฎหมายเฉพาะที่จะนำมาบังคับใช้เพื่อป้องกันการทุจริตต่อบัตรเครดิต และลงโทษผู้กระทำความผิดเกี่ยวกับบัตรเครดิตและการกระทำความผิดโดยอาศัยคอมพิวเตอร์หรือสื่ออิเล็คทรอนิคส์เป็นเครื่องมือ เมื่อมีความผิดเกิดขึ้นเจ้าพนักงานผู้บังคับใช้กฎหมายจะปรับการกระทำความผิดดังกล่าวให้เข้ากับฐานความผิดตาม ประมวลกฎหมายอาญา หรือความผิดตามพระราชบัญญัติที่มีลักษณะใกล้เคียงกัน แต่ไม่สามารถบังคับใช้กฎหมายได้อย่างมีประสิทธิภาพและครอบคลุมทุกการกระทำความผิด ประเทศสหรัฐอเมริกาได้บัญญัติกฎหมายบังคับโดยเฉพาะเพื่อป้องกันการทุจริตต่อข้อมูลส่วนบุคคลของผู้อื่นซึ่งรวมถึงข้อมูลบัตรเครดิต กฎหมายป้องกันการทุจริตต่อบัตรเครดิต และกฎหมายอาชญากรรมคอมพิวเตอร์ ส่วนประเทศอังกฤษก็ได้บัญญัติกฎหมายอาชญากรรมคอมพิวเตอร์เช่นกัน ซึ่งกฎหมายดังกล่าวสามารถนำมาบังคับใช้ร่วมกันได้อย่างมีประสิทธิภาพ เพื่อการป้องกันและปราบปรามการทุจริตในการใช้บัตรเครดิตบนอินเตอร์เนท สำหรับประเทศไทย เมื่อกฎหมายที่มีอยู่ในปัจจุบันไม่สามารถบังคับใช้ได้อย่างครอบคลุมและมีประสิทธิภาพ จึงควรบัญญัติกฎหมายเฉพาะมาบังคับใช้ เพื่อขจัดปัญหาและอุปสรรคดังกล่าว

Other Abstract (Other language abstract of ETD)

The purpose of this thesis is to investigate the effectiveness of the current Thai criminal laws in preventing and suppressing the acts of credit card frauds on the Internet, which involve crimes against other person’s credit card data via information technologies by the method of document researches. The research reveals that nowsdays there are no specific laws to be enforced with credit card, computer or electronic crimes in Thailand. When a crime is committed, law enforcement officer will analyze and compare that crime with traditional crime according to similar traditional criminal laws or other related bills. However, it is not efficient and does not cover all kinds of criminal activities. The United States of America has enacted specific laws applicable to crimes involving personal data and privacy including credit cards data. Credit Card Fraud Act and Computer Fraud and Abuse Act. The British government has also passed computer crime laws, which are enforced effectively with credit card fraud on the Internet. In Thailand, specific laws must be provided in order to get rid of obstacles and problems because the current traditional criminal laws cannot be enforced effectively.
