Abstract

การวิจัยนี้มีวัตถุประสงค์เพื่อที่จะทราบว่ามาตรการฝ่ายเดียวทางการค้า เพื่อคุ้มครองทรัพยากรร่วมของโลกนั้น ไม่สามารถกระทำได้ภายใต้กฎการค้าเสรีขององค์การการค้าโลก ในการศึกษาวิจัยผู้เขียนจะแสดงให้เห็นหลักการค้าเสรีที่สำคัญๆ ขององค์การการค้าโลกตามมาตรา I III XI ข้อยกเว้นเพื่อคุ้มครองสิ่งแวดล้อมตามมาตรา XX (b) และ (g) กรณีพิพาทต่างๆ ที่เกี่ยวข้องกับการนำเอาข้อยกเว้นดังกล่าวมาใช้ วิเคราะห์คำตัดสินภายใต้ข้อตกลงแกตต์และองค์การการค้าโลก ซึ่งได้แสดงให้เห็นถึงขอบเขตและเงื่อนไขของการนำเอาข้อยกเว้นตามมาตรา XX (b) และ (g) มาใช้บังคับซึ่งได้มีการตีความพัฒนาเรื่อยมาเป็นลำดับ นอกจากนี้ได้แสดงให้เห็นแนวทางในการคุ้มครอง และอนุรักษ์ทรัพยากรที่มีลักษณะเป็นทรัพยากรร่วมของโลก ของประชาคมโลกตามอนุสัญญาระหว่างประเทศต่างๆ และสุดท้ายได้มีการวิเคราะห์ถึงคำตัดสินของกรณีพิพาทเรื่อง United States-Import Prohibition of certain Shrimp and Shrimp Products ทั้งของคณะกรรมาการวินิจฉัยข้อพิพาทและขององค์กรอุทธรณ์ ผลของการวิจัยพบว่าองค์กรอุทธรณ์ในคดีนี้ได้พิจารณาและตัดสินว่า การใช้มาตรการทางการค้าในลักษณะห้ามนำเข้าสินค้า โดยอ้างข้อยกเว้นตามมาตรา XX (g) นั้นไม่สามารถกระทำได้ หากมิได้มีการคำนึงถึงมาตรการในการคุ้มครองและอนุรักษ์ ที่ประเทศนั้นได้ดำเนินการอยู่แล้ว ซึ่งตามคำตัดสินได้มีการตีความและเงื่อนไขของมาตรา XX (g) กว้างออกไปกว่ากรณีพิพาทที่ผานมาในอดีตหลายประการ ซึ่งอาจมีผลกระทบต่อนโยบายทางการด้านการค้า และสิ่งแวดล้อมของประเทศไทย ดังนั้นจึงต้องมีการปรับตัวและเร่งพัฒนานโยบายด้านสิ่งแวดล้อม มากขึ้นกว่าที่เป็นมา

Other Abstract (Other language abstract of ETD)

To study that the unilateral trade measure to protect the global commons is unacceptable action under the WTO trade rules. The researcher prescribed the core of WTO trade rules and the environmental protectional exception : Article I,III,XI and XX (b), (g). Moreover, the researcher analysied the GATT and WTO panel report and appellate body report in a related case. Beside that the researcher shown the global commons protectional trendency according to the multilateral agreements. Finally, the researcher analysied the panel and appellate body report : the United States-import prohibition of certain shrimp and shrimp products case. The research result shown the unilateral trade measure is unacceptable action. If it no concern with domestic environmental protectional measure which that country already apply for. The appellate body report was defined and interpreted the condition of Article XX more flexible than in the part. This might effect to the environmental and trade policy of Thailand. So we must adjust and speed up the development of environmental policy more than ever.
