Abstract

วิทยานิพนธ์นี้ ศึกษาบทบาทและอำนาจหน้าที่ของพนักงานสอบสวน ซึ่งเป็นกลไกหนึ่งของกระบวนการยุติธรรม ไม่ว่าจะเป็นอำนาจในการสอบสวน การจับกุม การตรวจค้น การออกหมายจับ การควบคุม และการพิจารณาการปล่อยตัวชั่วคราว เนื่องจากเป็นอำนาจที่เด็ดขาดไม่มีระบบการตรวจสอบและถ่วงดุลที่มีประสิทธิภาพ การศึกษาใช้การดำเนินการวิจัยเอกสารเป็นหลัก และสัมภาษณ์ผู้เกี่ยวข้อง เช่น เจ้าหน้าที่ตำรวจ ทนายความ ประชาชน และนักวิชาการ สรุปผลได้ว่า ขณะนี้ประเทศไทยเช้าสู่ความเป็นสากล การยอมรับหลักนิติธรรม (Rule of Law) มีความสำคัญและจะมีผลต่อความสัมพันธ์ระหว่างประเทศทั้งในด้านการเมือง เศรษฐกิจ และจะเห็นได้ว่าการแก้ปัญหาทางเศรษฐกิจ เงื่อนไขหนึ่งที่นานาชาติจับตามองก็คือ กระบวนการยุติธรรมของไทย ให้ความเป็นธรรมเพียงพอหรือไม่สอดคล้องกับหลักมนุษยชนหรือไม่ ดังนั้นการที่มีองค์กรอื่นไม่ว่าจะจะเป็นศาล พนักงานอัยการ ทนายความ และประชาชนอื่น ๆ เข้ามาตรวจสอบ และถ่วงดุลอำนาจหน้าที่ของเจ้าหน้าที่ตำรวจ จึงมีความจำเป็นอย่างยิ่งในโลกยุคปัจจุบัน เพื่อจะให้เป็นไปตามหลักการสากลที่นานาประเทศยอมรับ และเป็นหลักประกันว่ากระบวนการยุติธรรมโดยเฉพาะอำนาจหน้าที่ของตำรวจจะให้ความเป็นธรรมที่เพียงพอตามมาตรฐานที่นานาประเทศยอมรับ คือ มีลักษณะโปร่งใส สามารถตรวจสอบได้ และสิ่งสำคัญที่จะต้องดำเนินการควบคู่กันไปเพื่อที่จะเอื้ออำนวยเกื้อหนุนให้กระบวนการยุติธรรม ดำเนินไปได้ก็คือ จะต้องมีการสนับสนุนปัจจัยทางด้านการบริหารในส่วนต่าง ๆ เพื่อที่จะเอื้ออำนวย ให้กระบวนการยุติธรรมดำเนินการไปอย่างมีประสิทธิภาพและประสิทธิผล

Other Abstract (Other language abstract of ETD)

This thesis is aimed at studying the authority of inquiry officers who are a part of due process of law. The inquiry powers include inquiry, arrest, examination, issuing warrant of arrest, control, and temporary discharge. However, these powers are incomplete, for the lack of the check-and-balance system which lead to inefficiency. The study is based on documentary research and interviewing concerned people, such as police officers, lawyers, people, and technocrats. As a result of the study, it is concluded that, in so far as the globalization as to the rule of law is concerned, we have to improve our inquiry and examining process towards international due process of law, which is based on human rights. As a result, it is recommended that there should be other institutions, such as courts, public prosecuters, lawyers, and citizens, to empowered to check and balance the inquiry and examining officers. This is an emergent need for development in order to gain recognition from international states, for the international due process of law requires clean and accountable check, as well as the improvement of facilities which support the administration of law process with efficiency.
