Abstract
วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาปัญหาและแสวงหามาตรการทางกฎหมายเพื่อควบคุมสื่อทางเพศที่ใช้ความรุนแรง รวมทั้งศึกษาถึงแนวคิด รูปแบบ และมาตรการทางอาญาเกี่ยวกับสื่อทางเพศที่ใช้ความรุนแรงทั้งของประเทศไทยและต่างประเทศ อีกทั้งยังวิเคราะห์หลักเกณฑ์การกำหนดความผิดทางอาญาเพื่อนำมาปรับใช้กับมาตรการทางอาญาเกี่ยวกับสื่อทางเพศที่ใช้ความรุนแรงให้เหมาะสมกับบริบทของประเทศไทย จากการศึกษาพบว่าประเทศที่เปิดเสรีสื่อทางเพศมองว่าสื่อที่แสดงการกระตุ้นความต้องการทางเพศจะต้องได้รับการคุ้มครองในฐานะเสรีภาพในการแสดงออกรูปแบบหนึ่ง จึงมีการแบ่งแยกสื่อลามกออกจากสื่อทางเพศ โดยสื่อทางเพศใดที่พิจารณาแล้วว่ามีลักษณะเกินเลยไปจากขอบเขตมาตรฐานการยอมรับของสังคม เช่น มีการใช้ความรุนแรง ย่อมถือว่าเป็นสื่อลามกและเป็นข้อยกเว้นให้รัฐเข้ามาควบคุมการกระทำในทางส่วนตัวได้ เนื่องจากสื่อทางเพศที่ใช้ความรุนแรงสร้างผลร้ายแก่สังคมอย่างร้ายแรง สำหรับประเทศไทยกลับมองว่าสื่อทางเพศและสื่อลามกเป็นสิ่งเดียวกันเนื่องมาจากขอบเขตการตีความสื่อลามกกำหนดไว้ว่าสื่อที่แสดงการกระตุ้นความต้องการทางเพศแก่ผู้รับชมถือว่าเป็นสื่อลามกทั้งสิ้น ทำให้ประเทศไทยไม่มีการแบ่งแยกเนื้อหาของสื่อลามกแต่อย่างใด ผลที่ตามมาคือสื่อลามกทั่วไป (ยกเว้นสื่อลามกอนาจารเด็ก) และสื่อทางเพศที่ใช้ความรุนแรงถูกควบคุมในระดับเดียวกันภายใต้หลักห้ามการกระทำในลักษณะเปิดเผยแก่สาธารณะเท่านั้น การควบคุมสื่อทางเพศที่ใช้ความรุนแรงของประเทศไทยจึงยังไม่ครอบคลุมถึงการกระทำในทางส่วนตัวเหมือนกับประเทศที่เปิดเสรีสื่อทางเพศ ด้วยเหตุดังกล่าวผู้วิจัยเสนอแนะให้บัญญัติความผิดเกี่ยวกับสื่อทางเพศที่ใช้ความรุนแรงแยกออกจากบทบัญญัติเกี่ยวกับสื่อลามกทั่วไป โดยกำหนดความผิดเกี่ยวกับสื่อทางเพศที่ใช้ความรุนแรงครอบคลุมทั้งการกระทำในทางส่วนตัวและการกระทำในลักษณะเปิดเผยแก่สาธารณะ เพื่อเป็นการป้องกันและจัดการกับปัญหาสื่อทางเพศที่ใช้ความรุนแรงได้อย่างมีประสิทธิภาพ
Other Abstract (Other language abstract of ETD)
The purposes of this thesis are to study legal problems; to find legal measures for controlling violent pornography; to review the criminal concepts, patterns and measures about the violent pornography in Thailand and other countries; and to analyze the definitions of the criminal offence about the violent pornography for applying to the Thai context. It was found that the countries with free pornographic media considered that the media presenting sexual stimulations must be protected in a form of freedoms of expressions. Therefore, the obscene media was separated from pornographic media. Any pornographic media that exceeded the socially accepted standard boundaries, for example, by presenting violence was considered as obscenity and exempted by the government for personal control because the violent pornography severely affected the society .Unfortunately, the obscene media and pornographic media were considered as the same media in Thailand because it was defined that any media presenting sexual desires to audiences was considered as obscenity. Consequently, Thailand did not separate the contents of the pornography. As a result, the general pornography (except for child pornography) and violent pornography were controlled at the same level according to the principle of prohibiting public disclosure. Accordingly, the violent pornography control in Thailand does not cover personal actions as controlled in the countries with free pornographic media. Thus, it was suggested by the researcher to separate the violent pornography from the definition of the general pornography control by defining that the criminal offence about violent pornography covers both personal and public actions in order to efficiently prevent and handle the problems of the violent pornography.
