Abstract
กิจการไฟฟ้าถือเป็นการประกอบกิจกรรมทางเศรษฐกิจและการจัดทำบริการสาธารณะในกรณีที่ฝ่ายหนึ่งเข้ามามีนิติสัมพันธ์กับรัฐ ซึ่งในต่างประเทศมีการปฏิรูปเชิงโครงสร้างของกิจการไฟฟ้าจากการผูกขาดไปสู่การเปิดเสรี โดยประเทศไทยได้ดำเนินการตามสากล ด้วยการปฏิรูปเชิงโครงสร้างอันมีลักษณะเฉพาะตัว คือ Enhanced Single Buyer Model (ESBM) อย่างไรก็ดี สถาบันที่เกี่ยวข้อง ณ เวลานั้น คือ รัฐบาลและคณะกรรมการนโยบายพลังงานแห่งชาติเป็น “ผู้ออกนโยบาย” และการไฟฟ้าทั้งสาม เป็น “ผู้ปฏิบัติการ” ไม่มีการกำกับดูแลอย่างเพียงพอ รัฐจึงจัดให้มี “ผู้กำกับดูแล” ตราพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 จัดตั้งคณะกรรมการกำกับกิจการพลังงาน แต่ข้อเท็จจริงปรากฏว่าการผ่องถ่ายเพื่อเปิดเสรีพบกับข้อติดขัดหลายประการ ทำให้ปัจจุบันการดำเนินการบางประการอาจไม่สอดรับกับรูปแบบโครงสร้างดังกล่าว เช่น กรณีการจัดหาและรับซื้อไฟฟ้าของสถาบันต่าง ๆ ที่เกี่ยวข้อง วิทยานิพนธ์ฉบับนี้จึงได้ศึกษาเพื่อวิเคราะห์ และพบว่าโครงสร้างกิจการไฟฟ้าและพระราชบัญญัติฯ ทำให้อำนาจหน้าที่ ขอบเขตและภารกิจของผู้ออกนโยบาย ผู้กำกับดูแล และผู้ปฏิบัติการ เป็นไปอย่างสอดคล้องกับการเปิดเสรีในกิจการไฟฟ้าตามรูปแบบโครงสร้างกิจการไฟฟ้า ESBM และตามแนวความคิด ทฤษฎี และหลักการต่าง ๆ ของกฎหมายมหาชน ทั้งนี้ สำหรับการเปิดเสรีในกิจการไฟฟ้าอย่างเต็มรูปแบบตามสากลนั้น พระราชบัญญัติฯ ได้รองรับการปฏิรูปดังกล่าวไว้แล้วจากเนื้อหาของตัวบทกฎหมาย แต่มีความจำเป็นต้องปฏิรูปเชิงโครงสร้างควบคู่กันไปในทิศทางเดียวกันด้วย
Other Abstract (Other language abstract of ETD)
Electricity industry is an economic activity and the provision of public services. Which abroad, there is a structural reform of the electricity industry from monopoly to liberalization. In which Thailand has its unique structural reform, the Enhanced Single Buyer Model (ESBM), however, the institutions involved at that time were the Government and the National Energy Policy Council are “Policy makers” and the three electricity utilities are “Operators” without adequate regulatory. The state therefore provides "Regulators" by enacted the Energy Industry Act 2007 established the Energy Regulatory Commission. But the fact appears that the liberalization process was met with many problems. As a result, some operations may not be consistent with such a structure, such as in the case of electricity procurement of relevant institutions. This thesis was studied for analysis and found that the electricity industry structure and the Act have relations of authority framework and mission of policy makers, regulators, and operators are in line with the liberalization in the electricity structure model ESBM and according to the concepts, theories and principles of public law, for the full liberalization of the electric industry according to the international, Act has supported such reforms from the body of the law but there is a need for structural reforms going in the same direction.
