Abstract
การศึกษาวิจัย เรื่อง "แนวทางการลงโทษประหารชีวิตในสังคมไทย: ศึกษากรณีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางสหประชาชาติ" มีวัตถุประสงค์เพื่อศึกษาข้อกำหนดและแนวทางของสหประชาชาติ รวมถึงความสอดคล้องของสภาพสังคมไทยกับการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด และแนวทางที่เหมาะสมสำหรับสังคมไทยในการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามมาตรฐานสหประชาชาติ เป็นการศึกษาวิจัยเชิงคุณภาพ (Qualitative Research) โดยการวิจัยเอกสาร (Documentary Research) และการสัมภาษณ์เชิงลึก (In-depth Interview) จากกลุ่มผู้กำหนดนโยบาย ผู้นำนโยบายมาปฏิบัติ กลุ่มประชาสังคม และกลุ่มนักวิชาการ จำนวน 14 คน ผลการศึกษาพบว่า ข้อกำหนดและแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดของสหประชาชาติเป็นมาตรฐานสากลที่พึงปฏิบัติ แม้ว่าในแต่ละประเทศจะมีบริบททางสังคมและวัฒนธรรมที่แตกต่างกัน หากประเทศไทยกำหนดนโยบายการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดสอดคล้องต่อแนวทางของสหประชาชาติจะส่งผลให้สามารถลดความผิดพลาดในการดำเนินคดีอาญาด้วยการลงโทษผู้บริสุทธิ์ และลดผลกระทบต่อเหยื่อได้ แนวทางที่เหมาะสมในการใช้โทษประหารชีวิตในกรณีคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางของสหประชาชาติ คือ การใช้โทษประหารชีวิตเฉพาะในคดีเจตนาฆ่าทำให้ผู้อื่นเสียชีวิต และอาจพักการใช้โทษประหารชีวิตในทางปฏิบัติ อีกทั้งการนำมาตรการแทนการลงโทษประหารชีวิตในฐานความผิดที่มีอัตราโทษสูงถึงขั้นประหารชีวิตที่ไม่สอดคล้องต่อแนวทางของสหประชาชาติ คือ กำหนดโทษจำคุกเพิ่มเข้าไปในบางฐานความผิดที่มีบทลงโทษประหารชีวิตเพียงสถานเดียว, การใช้โทษจำคุกระยะยาวที่มีกำหนดระยะเวลาแน่นอนในการพ้นโทษ, การจำคุกตลอดชีวิตโดยไม่ได้รับการลดโทษ และการนำนักโทษประหารไปใช้ให้เกิดประโยชน์ในด้านต่าง ๆ อันเป็นประโยชน์ต่อสังคม เพื่อการเปลี่ยนแปลงแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด (Most Serious Crime) ที่สอดคล้องกับแนวทางของสหประชาชาติและเหมาะสมกับสังคมไทยในปัจจุบันและอนาคตสืบไป

The study on "A GUIDELINE FOR DEATH PENALTY IN THAI SOCIETY: A CASE STUDY OF UNITED NATIONS GUIDELINE ON MOST SERIOUS CRIME" aims to study the United Nations requirements and guidelines and the consistent in Thai society about the death penalty for the most serious crime according to the United Nations standards and guidelines and appropriate guidelines for Thai society in the death penalty for the most serious crime according to United Nations standards. Studying by using qualitative research method. Collected data by using documentary research and in-depth interview from the group of policymakers and policy operator and civil society group and academic group. With the purpose to change the guidelines for the death penalty for the most serious crime to comply and appropriate with Thai society. The study found that the United Nations death penalty requirements and guidelines for the most serious crime are the international standards. Even though each country has a different social and cultural context. If Thailand establishes a policy of the death penalty for the most serious crime following the United Nations guidelines, it will reduce the errors in criminal prosecution by punishing innocent people and reduce the impact on the victim. The most appropriate guidelines to use in the death penalty in the most serious crime is using the death penalty only in the case of killing intent, which resulted in the loss of life and may suspend the use of the death penalty in practice. Moreover, the alternative measures to replace the death penalty for the offenses with the high rate of capital punishment which do not comply with the United Nations guidelines are to add more imprisonment to some certain offenses that include only the death penalty, Long-term imprisonment with fixed-time to acquittal, Life imprisonment without mitigation and using the inmates awaiting execution to change the guidelines for the death penalty for most serious crime in line with the United Nations guidelines and suitable for Thai society.
