Abstract
อาชญากรรมเป็นปรากฏการณ์ของสังคมซึ่งเกิดจากความบกพร่องในการป้องกันอาชญากรรมของรัฐ เหยื่ออาชญากรรมจึงสมควรได้รับการช่วยเหลือในรูปแบบรัฐสวัสดิการจากนโยบายการช่วยเหลือเหยื่ออาชญากรรม วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อ ประเมินกระบวนการนำนโยบายไปสู่การปฏิบัติ ศึกษาสภาพและผลการดำเนินงานตามนโยบาย วิเคราะห์ปัจจัยที่ส่งผลกระทบต่อการดำเนินนโยบาย และจัดทำข้อเสนอเชิงนโยบายในการช่วยเหลือเหยื่ออาชญากรรม การศึกษานี้เป็นการวิจัยแบบผสมผสาน การวิจัยเชิงปริมาณเป็นการสืบค้นข้อมูลแนวกว้างจากกลุ่มตัวอย่างผู้มีส่วนได้ส่วนเสียในการดำเนินนโยบายการช่วยเหลืออาชญากรรมโดยใช้การวิจัยเชิงสำรวจ การวิจัยเชิงคุณภาพเป็นการสืบค้นข้อมูลแนวลึกเพื่ออธิบายข้อมูลเชิงปริมาณโดยใช้การวิจัยเอกสารและการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ ข้อมูลเชิงปริมาณวิเคราะห์โดยหาค่าความถี่ ร้อยละ ค่าเฉลี่ย ค่าส่วนเบี่ยงเบนมาตรฐาน การจัดอันดับ วิเคราะห์การถดถอยพหูคูณ ข้อมูลเชิงคุณภาพวิเคราะห์เนื้อหา สรุปประมวลผลเป็นความเรียง การผสมการวิเคราะห์ข้อมูลเชิงปริมาณและคุณภาพใช้วิธีเปรียบเทียบผลการศึกษาที่ได้แบบประเด็นต่อประเด็น ผลการศึกษาพบว่า ปัญหาหลักเป็นความเพียงพอของทรัพยากร การประชาสัมพันธ์สิทธิ์การได้รับการช่วยเหลือและเยียวยาจากภาครัฐ เหยื่ออาชญากรรมยังมีความรู้ความเข้าใจเกี่ยวกับนโยบายการช่วยเหลือเหยื่ออาชญากรรมน้อย การดำเนินการช่วยเหลือและเยียวยาเหยื่ออาชญากรรมยังมีความล่าช้า งบประมาณในการช่วยเหลือเหยื่ออาชญากรรมยังมีไม่เพียงพอ พนักงานสอบสวนของสำนักงานตำรวจแห่งชาติยังทราบว่ากรมคุ้มครองสิทธิและเสรีภาพมีเจ้าหน้าที่ประจำอยู่ที่สถานีตำรวจภูธรเมืองน้อย นอกจากนี้ ปัจจัยด้านนโยบาย การบริหารจัดการ การประชาสัมพันธ์ การจัดสรรทรัพยากร การพัฒนาระบบช่วยเหลือและเยียวยา คณะกรรมการและอุทธรณ์ และปฏิบัติการช่วยเหลือและเยียวยา เป็นปัจจัยที่ส่งผลกระทบต่อการดำเนินนโยบาย อย่างไรก็ตาม ข้อเสนอแนะในการดำเนินนโยบายในการช่วยเหลือเหยื่ออาชญากรรมในอนาคต ควรมีการกำหนดเกณฑ์ในการพิจารณาให้ชัดเจนและไม่คลุมเครือ ประชาสัมพันธ์การรับรู้สิทธิ์ให้เข้าถึงประชาชนทุกกลุ่ม เปิดโอกาสให้ผู้มีส่วนได้ส่วนเสียในนโยบายการช่วยเหลือเหยื่ออาชญากรรมเข้ามามีส่วนร่วมในการกำหนดนโยบายได้อย่างทั่วถึง เพื่อลดช่องว่างในการเข้าถึงการช่วยเหลือประชาชนของภาครัฐ ควรจัดตั้งกองทุนสำหรับช่วยเหลือเหยื่ออาชญากรรมโดยเฉพาะ โดยเงินกองทุนมาจากเงินประเดิมที่รัฐบาลจัดสรรให้ เงินอุดหนุนจากงบประมาณรายจ่ายประจำปี เงินหรือทรัพย์สินที่มีผู้บริจาคอุทิศให้ เงินที่ได้รับจากต่างประเทศหรือองค์กรระหว่างประเทศ ดอกผลและผลประโยชน์ที่เกิดจากกองทุน และไม่ควรให้เงินและทรัพย์สินของกองทุนต้องส่งคืนคลังเป็นรายได้แผ่นดินในแต่ละปีงบประมาณ

Crime is a social phenomenon that results from the shortcomings of the government in its crime prevention strategy. Thus, assistance should be provided to the crime victims in the form of the welfare state through the government's policy on crime victim assistance. The objectives of this dissertation are to assess the process of policy implementation, to study circumstances and result of policy implementation, to analyze factors affecting the policy implementation, and to propose policy recommendations on crime victim assistance. This study employs a mixed methods research. The quantitative research is in-breadth research conducted on a sample group of stakeholders involved in policy execution regarding victim assistance by using a survey research method. The qualitative research is in-depth research used to explain the quantitative data by conducting documentary research and in-depth interviews with key informants. The quantitative data were analyzed by calculating the frequency, percentage, mean, standard deviation and ordinal and by performing multiple regression analysis. The qualitative data were used for content analysis, summarized and processed into an essay. The integration of quantitative and qualitative analysis was carried out through comparing issue-by-issue findings. The study revealed that the major problem was the shortage of resources, inadequate publicity on rights to receive assistance and remedy from the government, crime victims' limited knowledge and understanding of the crime victim assistance policy, delay in the process of providing assistance and remedy to crime victims and shortfall of the budget for assisting crime victims. The inquiry officials of the Royal Thai Police also found that the Rights and Liberties Protection Department's officers stationed at provincial police stations were insufficient. Furthermore, the policy, management, publicity, resources management, assistance and remedy system development, committee and appeal, as well as the assistance and remedy operation are the factors that affect the success of the policy implementation. Nonetheless, in terms of implementing crime victim assistance policy hereafter, the victim assistance criteria should be clearly and unambiguously specified. The publicity on victim rights should be accessible by every group of persons. Opportunities should be opened extensively to all stakeholders involved in crime victim assistance policy so that they can engage in proposing policies. To reduce the gap in accessing government assistance, a crime victim assistance fund should be set up exclusively. The fund will consist of the initial fund received the government, allowance from the annual budget expenditure, money or asset received from donors, money received from foreign countries or international organizations, interests and benefits derived from the fund. The money and asset in the crime victim assistance fund should not be returned to the treasury as public revenue of each fiscal year.
