Abstract (Thai)

จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

Abstract (English)

A comparative study on antitrust enforcement between the United States and Japan finds that the objective of U.S. antitrust law is focusing on “efficiency” and “consumer welfare.” In the era of the digital economy, this emphasis has hindered U.S. enforcement agencies from effectively regulating monopolistic behavior by powerful platform-based electronic companies. That’s because consumers often benefit from such monopolies—even when other stakeholders, especially small and medium-sized enterprises (SMEs), are being disadvantaged. In contrast, Japan’s antimonopoly law is designed to uphold and preserve “free and fair competition,” which includes protecting SMEs from being exploited or harmed by unfair trade practices employed by large corporations. Thailand’s competition law shares the similar objective with Japan’s, including provisions against unfair trade practices. Based on the above comparison, this author proposes that Thailand’s enforcement agency should introduce secondary regulations to specifically govern the behavior of dominant e‑commerce platform currently operating in Thailand.
