Abstract (Thai)
บทความนี้มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ของระบบกฎหมายฝรั่งเศสในการจัดกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยอาศัยคณะตุลาการรัฐธรรมนูญเป็นองคาพยพในการจัดกลุ่มและพัฒนาหลักการทางรัฐธรรมนูญที่มีความเป็นพลวัตให้เกิดความชัดเจนภายใต้ทฤษฎีการจัดลำดับศักดิ์ของกฎหมาย โดยผลการศึกษาพบว่า คณะตุลาการรัฐธรรมนูญได้อาศัยบทบัญญัติของรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 ที่กำหนดให้คำวินิจฉัยของคณะตุลาการรัฐธรรมนูญมีผลผูกพันทุกองค์กรมาใช้ในการพัฒนากลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยการวินิจฉัยให้เอกสารทางกฎหมายอื่น ๆ ถือเป็นส่วนหนึ่งของกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ ซึ่งประสบการณ์ดังกล่าวสามารถนำมาปรับใช้กับระบบกฎหมายไทยได้ในกรณีที่ต้องมีการตีความเอกสารทางกฎหมายที่มีมาก่อนการประกาศใช้รัฐธรรมนูญให้มีสถานะดังเช่นรัฐธรรมนูญ รวมถึงการตีความหลักการทางกฎหมายที่เคยปรากฏในรัฐธรรมนูญฉบับก่อนแต่ไม่ปรากฏในรัฐธรรมนูญฉบับปัจจุบัน
Abstract (English)
This academic article has the objective to study the experience from the French legal system on arranging the Constitutional Bloc by designing the Constitutional Council as principal organization charging for developing its dynamic constitution-valued principles under the theory of hierarchy of law. The study found that the Constitutional Council draws upon the provisions of the Constitution of the French Republic, which stipulates that the decisions of the Constitutional Council are binding on all institutions, to develop the Constitutional Bloc by including other legal documents as part of the constitutional framework. The experience gained from this approach offers valuable insights that could be adapted to the Thai legal system in cases requiring the interpretation of legal documents that predate the promulgation of the current Constitution, granting them the same status as constitutional law. It could also be applied to the interpretation of legal principles from earlier constitutional texts that are not present in the current Constitution.
