Abstract
วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาขอบเขตของความผิดฐานเหยียดหยามศาสนาตามประมวลกฎหมายอาญา โดยมุ่งศึกษาถึงอิทธิพลและแนวคิดในการบัญญัติกฎหมายดังกล่าว นอกจากนั้นยังศึกษาเชิงเปรียบเทียบความผิดฐานดังกล่าวกับบทบัญญัติของกฎหมายที่เกี่ยวข้องกับการเหยียดหยามศาสนาในต่างประเทศ เพื่อนำมาวิเคราะห์เปรียบเทียบ และเสนอแนะแนวทางที่เหมาะสมในการปรับปรุงกฎหมายในความผิดฐานเหยียดหยามศาสนา จากการศึกษาพบว่า ความผิดฐานเหยียดหยามศาสนาที่ปรากฏอยู่ในประมวลกฎหมาย อาญานั้น ส่วนหนึ่งได้รับอิทธิพลมาจากประมวลกฎหมายอาญาของสาธารณรัฐอินเดีย เนื่องจากเป็นต้นร่างของความผิดฐานดังกล่าวในยุคที่มีการพิจารณาร่างประมวลกฎหมายลักษณะอาญา ร.ศ. 127 อีกส่วนหนึ่งนั้นได้รับอิทธิพลมาจากทางสังคม ไม่ว่าจะเป็นในเรื่องของศาสนาและวัฒนธรรม โดยเฉพาะศาสนาพราหมณ์-ฮินดู และศาสนาพุทธ ส่งผลให้ขอบเขตของวัตถุแห่งการกระทำในความผิดฐานเหยียดหยามศาสนาจำกัดอยู่ที่วัตถุและสถานที่ในทางศาสนาเท่านั้น นอกจากนั้นแล้ว ความผิดฐานดังกล่าวโดยเฉพาะในส่วนของพฤติการณ์ประกอบการกระทำเป็นส่วนที่ก่อให้เกิดความไม่ชัดเจนแน่นอนในตัวบทกฎหมาย อันเป็นการขัดต่อหลักการพื้นฐานของกฎหมายอาญาที่ต้องมีความชัดเจนและแน่นอน อีกทั้งความผิดฐานดังกล่าวในกฎหมายของต่างประเทศมุ่งที่จะเอาผิดแก่ผู้กระทำที่มีเจตนาพิเศษในความผิดฐานดังกล่าวทั้งสิ้น ในส่วนของบทกำหนดโทษตามความผิดฐานดังกล่าว ประเทศไทยมีการกำหนดอัตราโทษขั้นต่ำไว้ ซึ่งเป็นการจำกัดดุลพินิจของผู้พิพากษาที่จะพิพากษาความผิดดังกล่าวให้เกิดความเหมาะสมระหว่างการกระทำกับโทษที่ผู้กระทำควรจะได้รับ ซึ่งแตกต่างกับกฎหมายของต่างประเทศที่ไม่มีการกำหนดอัตราโทษขั้นต่ำไว้ ด้วยเหตุดังที่กล่าวมาข้างต้น ผู้วิจัยจึงทำการเสนอให้มีการแก้ไขเพิ่มเติมบทบัญญัติในส่วนของความผิดฐานเหยียดหยามศาสนาตามประมวลกฎหมายอาญา โดยแก้ไขเปลี่ยนแปลงในส่วนของพฤติการณ์ประกอบการกระทำ โดยเปลี่ยนมาเป็นเจตนาพิเศษเพื่อให้เกิดความชัดเจนในตัวบทบัญญัติ อีกทั้งยังแก้ไขในส่วนของอัตราโทษขั้นต่ำในความผิดฐานดังกล่าวให้มีความเหมาะสมยิ่งขึ้น
Other Abstract (Other language abstract of ETD)
The purposes of this thesis are to study the extend of the religious insult offense under the Criminal Code by focusing on the influences and concepts of the enactment of the mentioned law and to compare the mentioned offense with the religious insult laws in other countries in order to analyze and provide the appropriate guidelines for improving the law. It was found that the religious insult offense in the Criminal Code was partially influenced by the Criminal Code of the Republic of India because it was the original law stating the mentioned offense while the Penal Code for Kingdom of Siam R.S. 127 (1908) was being drafted. It was also partially and social influenced by regions and cultures, particularly Hinduism and Buddhism. Moreover, the mentioned offense, especially the attendant circumstance, caused the ambiguity of the law. This was inconsistent the basic principles of criminal laws that must be clear and certain. Additionally, the mentioned offense in other countries’ laws focused on implicating offenders with special intents about the mentioned offense. Regarding the punishments for the mentioned offense, Thailand has the minimum punishment that limited the discretion of judges who have to appropriate to judge the offense. This is different from the other countries’ laws without the minimum punishment. As previously mentioned, it is suggested by the researcher(s) to amend the provision regarding the religious insult offense under the Criminal Code by considering specific intents instead of the attendance circumstances in order to clarify the provision. It is also suggested to adjust the minimum punishment of the mentioned offense in order to make it reasonable.
