Abstract
ในการพิทักษ์สิ่งแวดล้อมระหว่างประเทศ ได้มีการการนำแนวความคิดสำคัญประการหนึ่งเข้ามาใช้ นั่นคือ แนวความคิดในการเข้าถึงข้อมูลข่าวสารทางด้านสิ่งแวดล้อมระหว่างประเทศของรัฐ และบุคคล ดังปรากฏแนวความคิดดังกล่าวแทรกอยู่ใน ข้อตกลงทางด้านสิ่งแวดล้อมระหว่างประเทศหลายฉบับ แต่จากอดีตที่ผ่านมายังไม่เคยมีการนำแนวความคิดดังกล่าว ไปกำหนดขึ้นเป็นหลักการเฉพาะเรื่อง การนำหลักการเข้าถึงข้อมูลข่าวสารทางด้านสิ่งแวดล้อมระหว่างประเทศของรัฐและบุคคล ไปกำหนดเป็นข้อตกลงระหว่างประเทศขึ้นโดยเฉพาะเป็นครั้งแรก ในอนุสัญญาว่าด้วยการเข้าถึงข้อมูลข่าวสาร และการมีส่วนร่วมของสาธารณะในการตัดสินใจ และการเข้าสู่กระบวนการยุติธรรมในคดีสิ่งแวดล้อม ค.ศ. 1998 (อนุสัญญาออร์ฮูส) ทำให้เกิดการตื่นตัวในสังคมระหว่างประเทศในการกำหนดให้หลักการดังกล่าว เป็นสิทธิขั้นพื้นฐานของรัฐและบุคคล ในการเข้าถึงข้อมูลข่าวสารสิ่งแวดล้อม โดยวิทยานิพนธ์นี้ได้ศึกษาถึงพัฒนาการของหลักการเข้าถึง ข้อมูลข่าวสารสิ่งแวดล้อมระหว่างประเทศ จนกระทั่งได้มีการนำหลักการเข้าถึงข้อมูลสิ่งแวดล้อม ไปกำหนดเป็นอนุสัญญาออร์ฮูส และได้นำหลักการเข้าถึงข้อมูลข่าวสารสิ่งแวดล้อม ในอนุสัญญาออร์ฮูสมาวิเคราะห์ข้อพิพาทระหว่างประเทศที่เกิดขึ้นแล้ว ซึ่งจะเป็นการพิสูจน์ว่าหลักการเข้าถึงข่าวสารสิ่งแวดล้อมตามอนุสัญญาออร์ฮูส สามารถนำไปใช้ในข้อตกลงระหว่างประเทศสิ่งแวดล้อมด้านอื่นๆ ในฐานะที่เป็นเครื่องมือสำคัญประการหนึ่ง ที่จะส่งผลทำให้มาตรการการบังคับใช้ กฎหมายสิ่งแวดล้อมระหว่างประเทศมีประสิทธิภาพมากยิ่งขึ้น
Other Abstract (Other language abstract of ETD)
Access to environmental information of state and person" is an important idea to protect international environment, but the idea is only appear in minor part of many international environmental agreements, not have been made for a specific international environmental agreement before. The first specific international environmental agreement in the idea was found in "The Convention on Access to Information, Public Participation in Decision-Making and Access to Justice in Environmental Matters 1998" (the Aarhus Convention) that interest international communities in the rights of state and person to access to international environmental information. This thesis, therefore, studied in development of the idea in the past until the Aurhus Convention and analysis international environmental dispute cases in the past with the agreements in the Aarhus convention that to prove the agreements in Aarhus Convention can be used in the other international environmental agreements as an efficient tool to that effect in theefficiently enforce the international environmental laws.
