Abstract

ศึกษาถึงความจำเป็นที่ประเทศไทยจะกำหนดมาตรการทางกฎหมายที่เหมาะสม ในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ ในผลิตภัณฑ์ไวน์และสุราในประเทศไทย เนื่องจากประเทศไทยมีพันธกรณีที่จะต้องให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ ในผลิตภัณฑ์ไวน์และสุราตามความตกลงว่าด้วยทรัพย์สินทางปัญญาที่เกี่ยวกับการค้า ซึ่งเปิดโอกาสให้ประเทศสมาชิกสามารถกำหนดมาตรการทางกฎหมายออกมารองรับ ในระบบที่แตกต่างกัน ปัจจุบันประเทศไทยยังมิได้กำหนดกรอบแนวความคิดที่ชัดเจน ในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ในผลิตภัณฑ์ไวน์และสุรา จึงมีปัญหาว่า กรอบของหลักกฎหมายที่เหมาะสมในการให้ความคุ้มครองควรจะมีลักษณะอย่างไร เพื่อเป็นหนทางที่จะนำไปสู่การวิเคราะห์เลือกกฎหมายคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ ในสินค้าไวน์และสุราให้สอดคล้องกับสภาพสังคมและเศรษฐกิจของประเทศไทย จากการศึกษาพบว่า กรอบและกลไกของกฎหมายที่เหมาะสมในการให้ความคุ้มครอง สิ่งบ่งชี้ทางภูมิศาสตร์ในผลิตภัณฑ์ไวน์และสุราในประเทศไทยจะเกิดขึ้นได้ โดยอาศัยปฏิสัมพันธ์ของกฎหมาย เศรษฐกิจ การเมืองและการพัฒนา จากการวิเคราะห์เกี่ยวกับกรอบแนวความคิด ในการให้ความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ ในผลิตภัณฑ์ไวน์และสุราตามหลักเกณฑ์ระหว่างประเทศ กฎหมายต่างประเทศ กฎหมายภายใน ประกอบกับการพิจารณามิติด้านเศรษฐกิจ การค้าและอุตสาหกรรมภายในประเทศพบว่า ประเทศไทยควรกำหนดแนวทางการให้ความคุ้มครองตามมาตรฐานขั้นต่ำ ที่ผูกพันอยู่ตามความตกลงว่าด้วยทรัพย์สินทางปัญญาที่เกี่ยวกับการค้า (TRIPS) เท่านั้น ซึ่งอาจทำได้โดยจัดทำระบบดูแลและควบคุมคุณภาพการผลิต รวมทั้งองค์กรซึ่งทำหน้าที่ควบคุมตรวจสอบคุณภาพของสินค้าไปพร้อมกัน ในระยะยาวเมื่ออุตสาหกรรมไวน์และสุราของประเทศไทยมีคุณภาพ ชื่อเสียงคุณลักษณะตามเงื่อนไขการได้รับความคุ้มครอง สิ่งบ่งชี้ทางภูมิศาสตร์ในมาตรฐานขั้นสูง จึงค่อยขยายความคุ้มครองสิ่งบ่งชี้ทางภูมิศาสตร์ในผลิตภัณฑ์ไวน์และสุราออกไป เพื่อปกป้องและคุ้มครองผู้ผลิต และผู้ประกอบการอุตสาหกรรมไวน์และสุราของประเทศไทย

To study and analyze what should be appropriate legal regime to protect geographical indications for wines and spirits. Thailand has an obligation to protect geographical indications for wines and spirits under Agreement on Trade Related Aspect of Intellectual Property Rights (TRIPS) which allows members to set different legal framework of protection. Thailand has not finalized the applicable framework for protection of geographical indications for wines and spirits. Therefore it is important to explore appropriate legal framework to protect geographical indication for wines and spirits in order to suit with social and economic context of Thai society. This study suggests legal framework and mechanism which protect geographical indications for wines and spirit in Thailand that takes into account prevailing, economics, political, and social development stages of local entrepreneur. The legal framework that the author examines consists of the legal concept of protection of geographical indications for wines and spirits under international law which are the Paris Convention, the Madrid Agreement, Lisbon Agreement and TRIPS Agreement ; foreign laws which include the U.S. Laws, European Union Laws as well as French Laws. As a result, Thailand should set protection framework according to minimum standard which Thailand has an obligation under the TRIPS Agreement . It is necessary to organize the relevant mechanism, quality control and product testing. In the long term when Thai wines and spirits industry improves, Thailand may consider more comprehensive protection in accordance with the high level protection standard of geographical indications.
