Abstract
การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาการบังคับใช้กฎหมายของคณะรักษาความสงบแห่งชาติ (คสช.) ในปี พ.ศ.2557 – 2562 ก่อนเลือกตั้ง ตามหลักเสรีประชาธิปไตย ตลอดจนศึกษาการวางฐานทางรัฐธรรมนูญและกฎหมายในการสืบทอดอำนาจของคณะรักษาความสงบแห่งชาติ วิธีการศึกษาดำเนินการใช้ระเบียบวิธีวิจัยเชิงคุณภาพ โดยการค้นคว้ารวบรวมข้อมูลทางเอกสารทางรัฐศาสตร์และนิติศาสตร์ จากแหล่งข้อมูลในการศึกษามาจากบทบัญญัติกฎหมาย หนังสือ บทความวารสาร งานวิจัยวิทยานิพนธ์ ข้อมูลสถิติหรือเอกสารเผยแพร่ทางราชการหรือหน่วยงานที่เกี่ยวข้อง ข้อมูลสารสนเทศจากเครือข่ายอินเตอร์เน็ต ตลอดจนการศึกษากฎหมาย รวมถึงการสัมภาษณ์เชิงลึก เพื่อนำมาวิเคราะห์ข้อมูลและสามารถนำมาปรับใช้กับงานวิจัยชิ้นนี้ ผลการวิจัยสรุปว่า คณะรัฐประหารรักษาความสงบแห่งชาติ (คสช.) พยายามใช้กฎหมายฉบับต่าง ๆ ดังนี้ ประการแรก การใช้กฎหมายทั่วไป ประการที่สอง การใช้รัฐธรรมนูญแห่งราชอาณาจักรไทย (ฉบับชั่วคราว) พุทธศักราช 2557 และประการสุดท้าย การใช้รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2560 เพื่อเป็นเครื่องมือในการเข้ามาควบคุมทางการเมือง ซึ่งไม่สอดคล้องกับหลักเสรีประชาธิปไตย อีกทั้ง ยังส่งผลต่อการวางรากฐานค้ำจุนให้กับระบอบรัฐประหารในระยะยาวอีกด้วย การวิจัยนี้จึงเสนอให้มีแนวทางในการแก้ไขปัญหาการใช้กฎหมายของคณะรัฐประหารดังกล่าวให้มีความสอดคล้องกับหลักเสรีประชาธิปไตย โดยอาศัยหลักประชาธิปไตยและหลักนิติธรรมควบคู่กัน ในลักษณะเป็นกลไกที่ส่งเสริมซึ่งกันและกันคือ การใช้กฎหมายเป็นกรอบในการควบคุมและจำกัดการใช้อำนาจ (rule of law) ของคณะรัฐประหารทุกช่วงเวลา เพื่อป้องกันการเข้ามารัฐประหาร รวมถึงคุ้มครองสิทธิและเสรีภาพของประชาชนไม่ให้ถูกละเมิดจากการใช้อำนาจดังกล่าว ฉะนั้น หากประเทศไทยสามารถทำให้หลักการนิติธรรมสามารถเกิดได้อย่างเป็นรูปธรรม หลักการดังกล่าวนั้นก็จะช่วยส่งเสริมระบอบประชาธิปไตยสามารถทำงานตรวจสอบและถ่วงดุลอำนาจได้อย่างมีประสิทธิภาพ
Other Abstract (Other language abstract of ETD)
The purpose of this study is to find out the enforcement of the National Council for Peace and Order (NCPO) in 2014 – 2019 before the election, as the principal of liberal democracy, including studying establishing the foundation of democracy and the laws for the succession of military power. The study method was performed using a qualitative research methodology by documentary political science and jurisprudence research. The sources of information in the study are legal provisions, books, articles, journals, thesis, statistical data or published documents of government or related agencies, information from the internet, law studies, including in-depth interviews, to analyze the data and apply to this study. The results were found that the military coup (NCPO) aimed to use various laws such as First the Constitution of the Kingdom of Thailand (interim) in 2014 Second the Constitution of the Kingdom of Thailand in 2017 and the use of the Law as a tool of gaining political control which was inconsistent with liberal democracy principles. In addition, the law has affected laying the foundations for the long-term sustaining of the coup regime. Therefore, this study proposes a solution to the NCPO laws to correspond with the liberal democracy principle by using the liberal democracy to complement the rule of law. Using the law to control and confine the rule of law of the coup d’etat council to prevent the coup and protect the people’s rights and liberties from being violated. Hence, if Thailand can objectify the rule of law, this principle can promote liberal democracy principal and be able to examine, check and balance efficiently
