Abstract

ระบบราคาน้ำมันเชื้อเพลิงแบบลอยตัวเป็นระบบที่ให้ผู้ประกอบการได้เข้ามามีบทบาทในการกำหนดราคาน้ำมันเชื้อเพลิงและมีการแข่งขันทางการค้าในธุรกิจน้ำมันเชื้อเพลิงมากขึ้น รัฐบาลได้ลดบทบาทจากการกำหนดและควบคุมราคาน้ำมันเชื้อเพลิงภายในประเทศเป็นเพียงการกำกับดูแล ไม่มีอำนาจหน้าที่ในการควบคุมตรวจสอบราคาโดยตรง และไม่มีมาตรการทางกฎหมายกำกับดูแลเป็นการเฉพาะ ระดับราคาน้ำมันเชื้อเพลิงที่มีการปรับตัวสูงขึ้นอย่างต่อเนื่อง ทำให้รัฐบาลต้องเข้าแทรกแซงราคาในการรักษาระดับราคาน้ำมัน เพื่อบรรเทาภาระราคาน้ำมันแพงให้แก่ประชาชน ประกอบกับการสนับสนุนพลังงานทดแทนและลดการใช้น้ำมันบางประเภท ด้วยวิธีการปรับอัตราโครงสร้างราคาน้ำมันเชื้อเพลิงตามมติและนโยบายต่างๆ ทำให้ราคาน้ำมันเชื้อเพลิงถูกบิดเบือนและไม่อาจสะท้อนต้นทุนที่แท้จริงได้ ซึ่งการดำเนินการตามมติและนโยบายต่างๆส่งผลให้เกิดการใช้พลังงานอย่างไม่มีประสิทธิภาพและเป็นการเอื้อประโยชน์ต่อกลุ่มผู้ค้าบางรายมากกว่าประโยชน์ที่ประชาชนพึงได้รับ บทกฎหมายควบคุมดูแลการจำหน่ายและผู้ประกอบการได้บัญญัติเป็นการทั่วไป จึงไม่อาจควบคุมดูแลพฤติกรรมการกระทำผิดที่เกิดขึ้นในระบบการซื้อขายน้ำมันเชื้อเพลิงระดับค้าปลีกได้ ทำให้ประชาชนถูกเอาเปรียบและไม่ได้รับการเยียวยาในความเสียหายที่เกิดขึ้น วัตถุประสงค์และเจตนารมณ์ของรัฐบาลในการบรรเทาภาระราคาน้ำมันแพงเพื่อให้ประชาชนได้ใช้น้ำมันเชื้อเพลิงในราคาที่เป็นธรรมนั้นจึงไม่อาจบรรลุผลได้ จึงควรมีมาตรการทางกฎหมายในการกำหนดราคาน้ำมันเชื้อเพลิงโดยการกำกับดูแลและตรวจสอบการกำหนดอัตราโครงสร้างราคาน้ำมันเชื้อเพลิงให้มีความเหมาะสม ประกอบกับการแก้ไขเพิ่มเติมบทบัญญัติว่าด้วยการค้าน้ำมันเชื้อเพลิง ให้ครอบคลุมถึงการกระทำผิดที่เกิดขึ้นในปัจจุบันและการควบคุมดูแลมิให้เกิดการเอาเปรียบระหว่างผู้ประกอบการกับผู้บริโภคและผู้ประกอบการด้วยกันเอง อันจะเป็นแนวทางในการรักษาสิทธิประโยชน์ของประชาชนและเป็นการกำกับดูแลราคาน้ำมันเชื้อเพลิงให้มีความเหมาะสมกับสถานการณ์

Other Abstract (Other language abstract of ETD)

Oil price deregulation system allows oil companies to take more roles in oil pricing and promotes oil business competition whereby the government has decreased its role in setting and controlling oil price in the country to be only monitoring. Accordingly, the government has no further authority to directly control the retail price and there are no specific legal measures governing oil pricing have been provided. Since oil price has been constantly increased and the government has to intervene in oil pricing in order to lessen burden of the consumers, and also to subsidise the use of alternative energy and to encourage the decrease in consumption of certain kinds of fuel. Various resolutions and polices of the government suggested restructuring of oil price; however, that caused price distortion and the real cost is not reflected. In addition, implementation of those resolutions and policies caused inefficient oil consumption and benefited certain oil companies rather than the consumers and the public. Regulations which control the sale and oil companies provide for general provisions that do not effectively control wrong-doings in the retail business level. As a result, people have been taken advantage of and no remedy has been provided, and objectives and desire of the government in lessening burden of people by way of paying fair oil price cannot be achieved. It is suggested that legal measures in prescribing oil price through monitoring and investigating the price structure be implemented, and provisions in fuel trade laws also be amended to ensure the enforceability over all present wrong-doings and that no advantage is taken of among the operators themselves and between operators and consumers. This could protect the rights and benefits of the consumers as well as the public and to monitor the oil price for suitability to the current situation.
