Abstract
สิทธิในการร้องขอความเป็นธรรมของข้าราชการตำรวจ เป็นการให้หลักประกันความเป็นธรรมและความมั่นคงในอาชีพแก่ข้าราชการตำรวจตามหลักการบริหารงานบุคคลในระบบคุณธรรม (Merit system) และเพื่อให้เกิดความสัมพันธ์อันดีระหว่างผู้บังคับบัญชากับผู้ใต้บังคับบัญชา ข้าราชการตำรวจบางรายไม่เข้าใจกฎหมายในเรื่องนี้ทั้งในส่วนของสิทธิในการร้องขอความเป็นธรรม เรื่องที่อาจร้องขอความเป็นธรรมได้และวิธีการร้องขอความเป็นธรรม การวิจัยในเรื่องนี้พบว่า ตัวบทกฎหมายในเรื่องการร้องขอความเป็นธรรมทั้งโดยการร้องทุกข์และการอุทธรณ์ยังไม่มีความชัดเจน และลักลั่นกันในหลายฉบับโดยเฉพาะกฎหมายว่าด้วยวินัยตำรวจ กฎหมายว่าด้วยระเบียบข้าราชการตำรวจ และกฎหมายว่าด้วยระเบียบข้าราชการพลเรือน ดังนั้น เพื่อให้ข้าราชการตำรวจได้รับการแก้ไขปลดเปลื้องทุกข์ได้ตามความประสงค์จึงควรแก้ไขกฎหมายที่เกี่ยวกับระบบรวมทั้งวิธีร้องขอความเป็นธรรมให้ชัดเจน และเป็นไปอย่างมีประสิทธิภาพสมดังเจตนารมณ์ของการร้อนขอความเป็นธรรมซึ่งจะทำให้กฎหมายเรื่องนี้บรรลุวัตถุประสงค์ และเป็นเครื่องมือในการบริหารงานบุคคลในระบบราชการตำรวจได้อย่างมีประสิทธิภาพยิ่ง
Other Abstract (Other language abstract of ETD)
The right to ask for justice and fairness in police personnel management tends to guarantee merit system and security of carrier for police officers. However, it seems that many of them do not understand the said right both in substantive and procedural aspects. It has been found in this research that provisions of laws concerning the exercise of this right through the process of grievance and appeal are ambiguous. Moreover, the laws on police discipline, on police personnel management and on civil service personnel management seem to have many discrepancies. It is therefore necessary that laws and regulations related to this right be amended in order to provide clear and efficient protection of the officers.
