วิจัยฉบับนี้พบว่า บทบัญญัติของพระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 เป็นอุปสรรคต่อการร่วมกันเพื่อพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล จึงมีความจำเป็นที่จะต้องมีการแก้ไขปรับปรุงพระราชบัญญัติฉบับนี้เพื่อเป็นการรื้อถอนอุปสรรคดังกล่าว โดยการเพิ่มเติมมาตรา 56/1 อันเป็นบทบัญญัติที่ยกเว้นการบังคับใช้มาตรา 54 และ 55 ให้แก่การร่วมกันอันมีวัตถุประสงค์ในการพัฒนาเงื่อนไขการทำงานของผู้ทำงานผ่านทางแพลตฟอร์มแรงงานดิจิตัล
Abstract (English)
This research found that the provisions of Trade Competition Act B.E. 2560 are obstacles to coordination with purpose of improving the working conditions of persons working through digital labour platforms. Therefore, it is necessary to amend this act in order to dismantle these obstacles by inserting section 56/1 which exempts the application of section 54 and 55 for coordination with purpose of improving the working conditions of persons working through digital labour platforms.
