Abstract (Thai)

บทความนี้มุ่งศึกษาถึงการคุ้มครองสิทธิอนามัยเจริญพันธุ์ของสตรีและผู้มีความหลากหลายทางเพศในบริบทประเทศไทย ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน เช่น อนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) หลักการยอกยาการ์ตา และเป้าหมายการพัฒนาที่ยั่งยืนข้อที่ 5 ซึ่งต่างยืนยันถึงสิทธิในการเข้าถึงสุขภาพทางเพศและอนามัยเจริญพันธุ์อย่างเสมอภาคและปราศจากการเลือกปฏิบัติ จากการศึกษาพบว่า แม้ประเทศไทยจะมีความก้าวหน้าในเชิงกฎหมายและนโยบาย แต่ยังคงเผชิญอุปสรรคสำคัญ อาทิ อคติจากผู้ให้บริการ ความเหลื่อมล้ำทางเศรษฐกิจและภูมิศาสตร์ ตลอดจนข้อจำกัดทางกฎหมายที่ยังไม่สอดคล้องกับมาตรฐานสิทธิมนุษยชนสากล การศึกษาวิจัยนี้จึงมุ่งศึกษาพัฒนาการและปัญหาทางกฎหมายและนโยบายของประเทศไทยที่เกี่ยวข้อง เช่น การยุติการตั้งครรภ์ การขยายสิทธิประโยชน์ด้านการคุมกำเนิด การบริการอนามัยเจริญพันธุ์ รวมถึงสิทธิในการเข้าถึงบริการยาฮอร์โมนและการยืนยันเพศสภาพ โดยศึกษาเปรียบเทียบกับการคุ้มครองสิทธิอนามัยเจริญพันธุ์ในสหราชอาณาจักร เยอรมนี และอินเดีย อันเป็นตัวอย่างการพัฒนากลไกกฎหมายและนโยบายที่ช่วยลดความเหลื่อมล้ำและสร้างระบบบริการที่เป็นมิตร เพื่อยกระดับกลไกทางกฎหมายและนโยบายสาธารณะของไทยให้สามารถส่งเสริมและสนับสนุนสิทธิอนามัยเจริญพันธุ์เกิดขึ้นจริง ภายใต้พันธกรณีระหว่างประเทศด้านสิทธิมนุษยชน และบรรลุเป้าหมายการพัฒนาอย่างยั่งยืนได้ต่อไป

Abstract (English)

This article examines the protection of sexual and reproductive health rights (SRHR) of women and gender-diverse persons in Thailand within the framework of international human rights obligations. Core instruments such as the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), the Yogyakarta Principles, and Sustainable Development Goal 5 affirm the right to equal and non-discriminatory access to sexual and reproductive health. According to the study, despite these developments, significant challenges remain. Structural and legal barriers, persistent biases among healthcare providers, and socio-economic as well as geographical disparities continue to limit effective access to SRHR services, which are inconsistent with the universal human rights standards. The study, therefore, explores the development and legal problems of Thai laws and policies, including safe abortion, expansion of contraceptive benefits under the Universal Health Coverage Scheme, and welfare measures related to reproductive health, and recognition of transgender persons' rights to access hormone therapy and gender-affirming healthcare. To identify possible approaches for improvement, the study compares Thailand's laws and policies with foreign laws, policies, and practices, particularly those in the United Kingdom, Germany, and India. According to the comparative study, more comprehensive legal and policy frameworks provide stronger and amicable safeguards to bridge the mechanism of Thailand's laws and public policies for promoting and supporting reproductive autonomy and equality under international human rights standards and to enable the accomplishment of sustainable development goals.
