Abstract (Thai)

คณะกรรมการกำกับกิจการพลังงาน (กกพ.) มีข้อจำกัดในการกำกับดูแลการประกอบกิจการไฟฟ้าเพื่อรองรับและส่งเสริมการเปลี่ยนผ่านด้านพลังงานสู่สังคมคาร์บอนต่ำตามพระราชบัญญัติการประกอบกิจการพลังงาน พ.ศ. 2550 (“พ.ร.บ. การประกอบกิจการพลังงานฯ”) ฉบับปัจจุบัน เนื่องจากยังไม่อาจออกใบอนุญาตประกอบกิจการไฟฟ้าสำหรับกิจการที่เกิดขึ้นใหม่ เช่น การประกอบกิจการนำเข้าและการส่งออกไฟฟ้า การรวบรวมโหลดไฟฟ้า การจัดการระบบจัดเก็บไฟฟ้า การประกอบกิจการโรงไฟฟ้าเสมือน และการประกอบกิจการไฟฟ้าและการให้บริการไฟฟ้าโดยผ่านระบบเทคโนโลยีสารสนเทศ ดังนั้น จึงควรมีการแก้ไขนิยามของกิจการไฟฟ้าตามกฎหมายให้ครอบคลุมการประกอบกิจการเหล่านี้ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขเพื่อรองรับสถานะของผู้ใช้ไฟฟ้าที่ผลิตไฟฟ้าได้เองให้ชัดเจน และมีบทบัญญัติที่รองรับสิทธิของบุคคลเหล่านี้ในการผลิต ใช้ และขายไฟฟ้าส่วนให้ผู้ใช้ไฟฟ้ารายอื่นได้ นอกจากนี้ เพื่อให้กฎหมายมีศักยภาพในการรับรองและคุ้มครองสิทธิในการเชื่อมต่อและใช้ระบบโครงข่ายไฟฟ้าเพื่อการส่งผ่านไฟฟ้าที่ผลิตจากพลังงานหมุนเวียนเพื่อรองรับการซื้อขายไฟฟ้าระหว่างเอกชนซึ่งมิได้เป็นเจ้าของโครงข่ายไฟฟ้าเอง กฎหมายจึงควรเพิ่มบทบัญญัติกำหนดหน้าที่ของผู้ประกอบกิจการไฟฟ้าที่มีระบบโครงข่ายให้คำนึงถึงการใช้ระบบโครงข่ายของผู้ผลิตไฟฟ้าจากทรัพยากรพลังงานหมุนเวียนอีกด้วย โดยยังคงรักษาความเชื่อถือได้ของระบบโครงข่ายไฟฟ้าเอาไว้ เมื่อการเปลี่ยนผ่านด้านพลังงานอาศัยการมีปฏิสัมพันธ์และการทำธุรกรรมแบบกระจายศูนย์ซึ่งผู้ผลิตและผู้ใช้ไฟฟ้าซื้อขายและส่งมอบไฟฟ้ากันโดยแบบที่มีการแข่งขันกัน กกพ. จึงควรมีอำนาจเพิ่มเติมในการเสนอให้คณะกรรมการนโยบายพลังงานแห่งชาติให้ความเห็นชอบการตั้งตลาดพลังงาน และเพื่อส่งเสริมตลาดไฟฟ้าในประเทศไทย พ.ร.บ. การประกอบกิจการพลังงานฯ และควรเพิ่มบัญญัติซึ่งกำหนดห้ามมิให้ผู้รับใบอนุญาตประกอบกิจการระบบโครงข่ายไฟฟ้ามีพฤติกรรมหรือการประกอบการอันมีลักษณะเป็นอุปสรรคต่อการจัดตั้งและพัฒนาของตลาดไฟฟ้า เพื่อให้การกำกับดูแลการประกอบกิจการไฟฟ้าสามารถก้าวตามพลวัตการเปลี่ยนผ่านด้านพลังงานในระดับสากล กกพ. จึงควรมีอำนาจกำกับกิจการพลังงานให้เป็นไปตามมาตรฐานตามกรอบความร่วมมือระหว่างประเทศด้านพลังงานและสิ่งแวดล้อมที่มีผลผูกพันประเทศไทย ในมิติของอัตราค่าบริการ พ.ร.บ. การประกอบกิจการพลังงานฯ ควรถูกแก้ไขให้เป็นฐานทางกฎหมายให้ กกพ. สามารถกำกับดูแลอัตราค่าบริการให้เหมาะสมกับกิจการไฟฟ้าแต่ละประเภท นอกจากนี้ กฎหมายควรกำหนดให้สัญญาเพื่อจัดหาไฟฟ้าโดยเฉพาะอย่างยิ่งที่รัฐรับซื้อไฟฟ้าจากเอกชนข้อสัญญาที่ทำให้เกิดความยืดหยุ่นในการคิดอัตราค่าไฟฟ้าซึ่งอาจลดต่ำลงจากการเปลี่ยนแปลงสภาพเศรษฐกิจ สังคม การลงทุน หรือเทคโนโลยีในมาตรฐานของสัญญาเกี่ยวกับการให้บริการพลังงาน

Abstract (English)

The Energy Regulatory Commission (ERC) has faced challenges in exercising its regulatory powers under the current Energy Industry Act B.E. 2550 (2007) (“EIA Act”) in advancing the energy transition toward a low-carbon society. This challenge arises from the lack of a legal framework to issue energy licenses for new electricity operation activities, such as electricity import and export, load aggregation, energy storage management, virtual power plants, and electricity transactions via IT systems. To address this, the definition of the “electricity industry” under the EIA Act should be expanded to include these activities as licensable. Furthermore, the legislation needs to be amended to explicitly recognize “self-consumption electricity producers” and their rights to generate, use, and sell excess electricity from their own consumption to other users. The EIA Act should also enhance its ability to acknowledge and enforce the rights of electricity producers and users to connect to and utilize electricity grids owned by other operators for electricity wheeling services related to private power purchase agreements. This would require electricity grid operators to consider these wheeling activities while ensuring the reliability of the grid. As distributed energy generation and direct commercial transactions between producers and users are closely linked to the energy transition, the ERC’s authority should be expanded to propose the formulation and development of electricity markets to the National Energy Policy Council for approval. To foster electricity markets in Thailand, the EIA Act should mandate grid operators to avoid abusive or unfair practices that may hinder market development. To align regulatory powers with the evolving international energy transition landscape, the ERC’s authority under the EIA Act should be strengthened to support Thailand’s commitments under legally binding international energy and environmental agreements. Regarding price control, the EIA Act should provide a legal foundation that enables the ERC to effectively regulate the prices of various electricity operations. It should also incorporate price flexibility to allow for adjustments in electricity pricing that reflect changes in economic conditions, societal needs, investments, and technological advancements, particularly in power purchase agreements where the state procures electricity from private producers.
