Abstract
การที่เกมคอมพิวเตอร์เป็นสื่อประเภทหนึ่งที่สามารถสื่อสารเนื้อหา และมีอิทธิพลต่อความคิดและการกระทำของบุคคลได้ จึงทำให้รัฐทั่วโลกให้ความสำคัญกับการกำกับดูแลเกมคอมพิวเตอร์เพื่อป้องกันผลกระทบของเกมที่อาจเกิดขึ้นต่อสังคม ซึ่งสำหรับประเทศไทยนั้น แม้ว่ารัฐจะได้มีการประกาศใช้กฎหมายเพื่อการกำกับดูแลเกมดังกล่าวแล้ว ก็ตาม แต่จากข้อเท็จจริงปรากฏว่า การกำกับดูแลเกมของประเทศไทยในปัจจุบันยังไม่มีประสิทธิภาพ และไม่อาจคุ้มครองสิทธิเสรีภาพของประชาชนได้อย่างเต็มที่ วิทยานิพนธ์ฉบับนี้จึงมุ่งที่จะศึกษาถึงประเด็นปัญหาของกำกับดูแล เกมคอมพิวเตอร์ตามระบบกฎหมายไทยในปัจจุบัน โดยเปรียบเทียบกับการกำกับดูแลเกมของต่างประเทศ ซึ่งได้แก่ สาธารณรัฐเกาหลี และสหพันธ์สาธารณรัฐเยอรมนี ซึ่งเป็นประเทศที่ได้รับการยอมรับว่ามีกฎหมายเกี่ยวกับการกำกับดูแลเกมที่มีประสิทธิภาพและทันสมัยเพียงพอต่อการเจริญก้าวหน้าของอุตสาหกรรมเกม และสามารถคุ้มครองสิทธิเสรีภาพของประชาชนได้อย่างเหมาะสม จากการศึกษา พบว่า การกำกับดูแลเกมคอมพิวเตอร์ตามระบบกฎหมายไทยมีความไม่เหมาะสมและ ไม่ทันสมัย จากการที่บทบัญญัติแห่งกฎหมายในการกำกับดูแลเกมที่บังคับใช้อยู่นั้นมีข้อจำกัดในเรื่องต่าง ๆ และการมีองค์กรกำกับดูแลเกมที่ไม่เอื้ออำนวยต่อการกำกับดูแลเกมคอมพิวเตอร์ จึงได้เสนอถึงแนวทางในการบัญญัติกฎหมายให้สอดคล้องกับการกำกับดูแลเกมในสภาวการณ์ปัจจุบัน และการจัดตั้งองค์กรกำกับดูแลที่เหมาะสมกับการกำกับดูแล เกมคอมพิวเตอร์ ซึ่งจะเป็นหนทางที่จะทำให้การกำกับดูแลเกมคอมพิวเตอร์ตามระบบกฎหมายไทยมีประสิทธิภาพ มากยิ่งขึ้น โดยทำให้รัฐสามารถคุ้มครองสิทธิและเสรีภาพของประชาชนที่เกี่ยวข้องได้อย่างถ้วนหน้า ไปพร้อม ๆ กับ การแสวงหาประโยชน์ในทางเศรษฐกิจจากอุตสาหกรรมเกมคอมพิวเตอร์ได้อย่างเต็มที่ต่อไป
Other Abstract (Other language abstract of ETD)
Computer game is one of the media which its contents can influence on thoughts and actions of people. As a result, many countries emphasize the importance of computer games regulation in order to prevent the potential impact of games on society. In Thailand, although the government has already enacted the law to regulate the computer games, it appears that computer games regulation is currently not effective and cannot fully protect people’s rights and liberties. This thesis therefore aims to study the issues of computer game regulation problems under the current Thai legal system by comparing with the computer games regulations in foreign countries which are the Republic of Korea and the Federal Republic of Germany. These two above-mentioned countries are recognized as the countries having effective and modern legislations regarding computer games regulation which are suitable for advancement of the gaming industry. Such legislations are properly able to protect people’s rights and liberties, as well. The study finds that the regulation of computer games under the Thai legal system is inappropriate and out-of-date owning to the limitation of legislations in relation to computer games regulation and the impropriety of the current regulatory bodies. Hence, this thesis will propose the guidelines for enacting the legislations which are in accordance with the current situation of computer games regulation and for establishing the regulatory body which is suitable for computer games regulation. These proposals would be the mean to improve the computer games regulation in Thailand more effective. As a consequence, the government is able to properly protect people’s rights and liberties and to exploit the Economic benefits from the computer game industry, simultaneously.
