Abstract

ศึกษาวิวัฒนาการของแนวคิดเกี่ยวกับสิทธิทางการศึกษาในระบบของการศึกษาไทย ตั้งแต่ พ.ศ. 2435-พ.ศ. 2540 โดยการวิจัยเอกสาร และการวิเคราะห์เชิงอุปมัยโดยมีกรอบของการวิจัย 11 ประเด็น ได้แก่ (1) สิทธิที่จะได้รับการศึกษาแบบให้เปล่าในการศึกษาภาคบังคับ (2) สิทธิทางการศึกษาระดับมัธยมศึกษาในรูปแบบต่างๆ (3) สิทธิแห่งความเสมอภาคในการเข้าศึกษาในสถาบันระดับอุดมศึกษา (4) สิทธิที่จะรู้หนังสือ (5) สิทธิที่จะได้รับการศึกษาตลอดชีวิต (6) สิทธิที่จะเรียนรู้เกี่ยวกับค่านิยมขนบธรรมเนียมประเพณี และวัฒนธรรมของกลุ่มชน (7) สิทธิที่จะได้รับการแนะแนวอาชีพ (8) สิทธิที่จะเรียนรู้เกี่ยวกับสิทธิมนุษยชน (9) สิทธิในการเลือกประเภทการศึกษาให้กับบุตรหลาน (10) สิทธิที่จะมีเสรีภาพทางความคิด มโนธรรม และศาสนา (11) สิทธิที่จะมีส่วนร่วมในการศึกษา ผลการวิจัยสรุปได้ดังนี้ ช่วงที่ 1 (พ.ศ. 2435-2463) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 7 ประเด็น กล่าวคือ สาระบัญญัติในกฎหมาย 6 ประเด็น ได้แก่ ประเด็นที่ 1, 3, 4, 9, 10 และ 11 แนวคิดเกี่ยวกับสิทธิทางการศึกษา 4 ประเด็น ได้แก่ ประเด็นที่ 1, 6, 10 และ 11 ช่วงที่ 2 (พ.ศ. 2464-2474) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 4 ประเด็น กล่าวคือสาระบัญญัติในกฎหมาย 3 ประเด็น ได้แก่ ประเด็นที่ 1, 9 และ 11 แนวคิดเกี่ยวกับสิทธิทางการศึกษา 1 ประเด็น คือประเด็นที่ 10 ช่วงที่ 3 (พ.ศ. 2475-2487) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 7 ประเด็น กล่าวคือสาระบัญญัติในกฎหมาย 4 ประเด็น ได้แก่ ประเด็นที่ 1, 3, 10 และ 11 ปรากฏแนวคิดเกี่ยวกับสิทธิทางการศึกษา 7 ประเด็น ได้แก่ ประเด็นที่ 1, 3, 4, 8, 9, 10 และ 11 ช่วงที่ 4 (พ.ศ. 2488-2503) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 8 ประเด็น กล่าวคือ สาระบัญญัติในกฎหมาย 5 ประเด็น ได้แก่ ประเด็นที่ 1, 3, 6, 10 และ 11 แนวคิดเกี่ยวกับสิทธิทางการศึกษา 5 ประเด็น ได้แก่ ประเด็นที่ 1, 2, 3, 4 และ 9 ช่วงที่ 5 (พ.ศ. 2504-2515) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 7 ประเด็น กล่าวคือ สาระบัญญัติในกฎหมาย 3 ประเด็น ได้แก่ ประเด็นที่ 1, 3 และ 11 แนวคิดที่เกี่ยวกับสิทธิทางการศึกษา 7 ประเด็น ได้แก่ ประเด็นที่ 1, 2, 3, 4, 7, 9 และ 11 ช่วงที่ 6 (พ.ศ. 2516-2540) ปรากฏสาระที่เกี่ยวกับสิทธิทางการศึกษา 11 ประเด็น กล่าวคือสาระบัญญัติในกฎหมาย 6 ประเด็น ได้แก่ ประเด็นที่ 1, 3, 5, 6, 10 และ 11 ส่วนแนวคิดที่เกี่ยวกับสิทธิทางการศึกษา ปรากฏทุกประเด็นตามกรอบการวิจัย

Examine the evolution of the perspectives on educational rights in Thai education system from the range of B.E. 2435-2540. Research methods are documentary research and analytic induction. 11 perspectives are thoroughly examined : (1) the right to free and compulsory education, (2) the right to secondary education in different forms by all appropriate means, (3) the right to equal access to higher education, (4) the right to acquire fundamental literacy, (5) the right to lifelong education, (6) the right to learn the values and customs of one's group, (7) the right to obtain vocational guidance, (8) the right to learn about human right, (9) the right of parents to choose the kind of education that will be given to their children, (10) the right to freedom of thought, conscience and religion, (11) the right to educational participation. The study revealed that from the first period of B.E. 2435-2464, 7 perspectives on the educational rights are stated. There are 6 issues (1, 3, 4, 9, 10, 11) found in legalized documents and 4 perspectives on educational rights (1, 6, 10, 11). The second period of B.E. 2464-2474, 4 perspectives on the educational rights are stated. There are 3 issues (1, 9, 11) found in legalized documents and 1 perspectives on educational rights (10). The third period of B.E. 2475-2487, 7 perspectives on the educational rights are stated. There are 4 issues (1, 3, 10, 11) found in legalized documents and 7 perspectives on educational rights (1, 3, 4, 8, 9, 10, 11). The fourth period of B.E. 2488-2503, 8 perspectives on the educational rights are stated. There are 5 issues (1, 3, 6, 10, 11) found in legalized documents and 5 perspectives on educational rights (1, 2, 3, 4, 9). The fifth period of B.E. 2504-2515, 7 perspectives on the educational rights are stated. There are 3 issues (1, 3, 11) found in legalized documents and 7 perspectives on educational rights (1, 2, 3, 4, 7, 9, 11). The sixth period of B.E. 2516-2540, 11 perspectives on the educational rights are stated. There are 6 issues (1, 3, 5, 6, 10, 11) found in legalized documents and 7 perspectives on educational rights are found in all 11 issues.
