Abstract
วิทยานิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาถึงการเตรียมความพร้อมของประเทศไทยในการเข้าเป็นภาคีอนุสัญญาระหว่างประเทศว่าด้วยการควบคุมระบบป้องกันเพรียงที่เป็นอันตรายในเรือ ค.ศ. 2001 ขององค์การทางทะเลระหว่างประเทศซึ่งอนุสัญญาที่องค์การทางทะเลระหว่างประเทศบัญญัติขึ้นเพื่อกำหนดมาตรฐานและแนวปฏิบัติเพื่อความปลอดภัยในการเดินเรือ การรักษาความปลอดภัยในการขนส่งระหว่างประเทศและคุ้มครองสิ่งแวดล้อมทางทะเลที่เกิดจากเรือรวมทั้งเพื่อเป็นกลไกในการสร้างความร่วมมือทางวิชาการระหว่างประเทศสมาชิก จากการศึกษาพบว่า หากประเทศไทยเข้าร่วมเป็นภาคีอนุสัญญาฉบับนี้ย่อมก่อให้เกิดผลดีมากกว่าผลเสียทั้งในฐานะรัฐเจ้าของธง รัฐเจ้าของเมืองท่า และเป็นประโยชน์ต่อเจ้าของเรือหรือบริษัทผู้บริหารเรือทั้งด้านการประหยัดค่าใช้จ่ายในการบำรุงรักษาตัวเรือ ค่าใช้จ่ายในด้านความสิ้นเปลืองน้ำมันเชื้อเพลิง การที่ประเทศไทยเข้าร่วมเป็นภาคีอนุสัญญาจะทำให้ประเทศไทยต้องมีพันธกรณีในการอนุวัติการกฎหมาย ซึ่งต้องมีการแก้ไขหรือปรับปรุงกฎหมายภายในให้มีความสอดคล้องกับอนุสัญญาฯ หากแม้ประเทศไทยยังมิได้เข้าร่วมเป็นภาคีอนุสัญญาฉบับนี้ แต่ประเทศไทยก็สามารถที่จะมีการหยิบและเลือก (Pick and Choose) โดยการนำเอาหลักการหรือข้อบัญญัติของอนุสัญญามาบัญญัติเอาไว้ในกฎหมายภายในของประเทศไทยในอนาคตได้ หากเห็นว่าหลักการหรือข้อบัญญัติอื่นใดเป็นประโยชน์ในการยกระดับมาตรฐานเรือไทยในด้านที่เกี่ยวกับการรักษาสภาพแวดล้อมทางทะเล
Other Abstract (Other language abstract of ETD)
This thesis aims to study for preparation of Thailand becoming a party to the international convention on the control of harmful anti-fouling systems on ship 2001 (AFS convention) by The International Maritime Organization (IMO) and the purpose of IMO conventions for measures to improve the maritime safety and maritime security of international shipping and to prevent marine pollutions from ships including academic cooperation between member states. According to the studies, it has been found that if Thailand becomes a party to the Convention, it will effective which flag State ,Port State. It is also beneficial to the ship owners or the management companies of the ships, in terms of saving on maintenance costs and fuel consumption. If Thailand becomes a party of this convention, Thailand will be obliged to implement some provisions of this convention through amendment or enactments the national laws and regulations in accordance with positive impact rather with convention. Even if Thailand is not a party to this Convention. But Thailand can pick and choose by adopting the principles or provisions of the Convention into the internal laws of Thailand in the future. If any of the principles or other provisions are useful in upgrading Thai ships standards in respect of the maintenance of the marine environment.
