Abstract

กรณีการรวมกลุ่มของกลุ่มการค้าเสรีอเมริกาเหนือ หรือ NAFTA มีวัตถุประสงค์หลักในการสร้างบรรยากาศการค้าเสรีระหว่างประเทศภาคีสมาชิกไปพร้อมกับการให้ความสำคัญกับประเด็นเรื่องมาตรฐานแรงงาน จึงได้มีการออกความตกลงข้างเคียงว่าด้วยเรื่องแรงงาน ชื่อว่า ความร่วมมือด้านแรงงานในความตกลงอเมริกาเหนือ (ความตกลง NAALC) ซึ่งมีลักษณะพิเศษที่แตกต่างจากการบังคับใช้อนุสัญญาขององค์การแรงงานระหว่างประเทศ คือ การนำมาตรการลงโทษทางเศรษฐกิจมาบังคับใช้กับประเทศภาคีสมาชิกที่ละเมิดพันธกรณีภายใต้ความตกลง NAALC และเนื่องจาก NAFTA เป็นการรวมกลุ่มทางเศรษฐกิจที่มีประเทศภาคีสมาชิกประกอบด้วยประเทศที่พัฒนาแล้วและประเทศที่กำลังพัฒนา จึงทำให้ NAFTA มีลักษณะการรวมกลุ่มที่ใกล้เคียงกับประชาคมอาเซียนเป็นอย่างยิ่ง ดังนั้น ประชาคมอาเซียนจึงอาจใช้ความ ตกลง NAALC เป็นแนวทางในการออกมาตรการเรื่องแรงงาน เพื่อทำให้เกิดการปฏิบัติตามมาตรฐานแรงงานหลักภายในกลุ่มประเทศภาคีสมาชิกมากขึ้นได้ จากการศึกษาการบังคับใช้ความตกลง NAALC พบว่า ความตกลงฉบับนี้เป็นกรณีที่ก่อให้เกิดการปฏิบัติตามมาตรฐานแรงงานหลักมากขึ้น โดยเฉพาะอย่างยิ่งทำให้เกิดความร่วมมือระหว่างประเทศภาคีสมาชิกในการแสวงหามาตรการเพื่อป้องกันและแก้ไขปัญหาการละเมิดสิทธิแรงงานอย่างเป็นรูปธรรมมากขึ้น และนำมาสู่ความกดดันต่อประเทศภาคีสมาชิก เพื่อสร้างความเปลี่ยนแปลงนโยบายด้านการคุ้มครองแรงงานและทำให้การบังคับใช้กฎหมายแรงงานภายในประเทศมีประสิทธิภาพมากขึ้น นอกจากนั้นยังส่งผลต่อพฤติกรรมเกี่ยวกับการคุ้มครองแรงงานของผู้ประกอบการภายในประเทศภาคีสมาชิกที่เปลี่ยนไปในทางที่ดีขึ้นอีกด้วย อย่างไรก็ตาม ยังคงมีข้อบกพร่องบางประการที่ทำให้การบังคับใช้ความตกลงฉบับนี้ไม่เต็มประสิทธิภาพเท่าที่ควร ได้แก่ ข้อจำกัดที่เกิดจากตัวบทของความตกลง NAALC และข้อจำกัดที่เกิดจากผู้มีอำนาจบังคับใช้ความตกลง NAALC นั้นเอง

The economic integration of North American Free Trade Agreement (NAFTA) mainly aims to establish free trade among NAFTA member states concurrently with the emphasis on the issue of labor standards, where the side agreement concerning labor issues has been made named “North American Agreement on Labor Cooperation" (NAALC). The characteristic of NAALC is different from the Conventions of the International Labor Organization (ILO) in terms of the punitive measures. NAALC imposes the economic sanction against the member state that violates its obligation under NAALC. Since NAFTA member states consist of both developed countries and developing countries, it looks similar to ASEAN Community. Thus, ASEAN Community could use the NAALC as a guideline to establish labor measures so as to improve the compliance of Core Labor Standards within its community. The study found that NAALC has effected more compliance of Core Labor Standards. In particular, the cooperation among the member states in pursuing the measures to prevent and resolve labor right violations is more concrete. It has led the member states to make change in their policies on the protection and enforcement of labor legislations to be more effective. Additionally, it can also enhance the behaviors of enterprises in the member states for better protection of the workers. However, there are some loopholes which cause limitations of enforcement of the agreement including the limitations caused by the NAALC provisions itself, as well as, by the competent authorities relating to the NAALC enforcement.
