Abstract

ทนายความคือผู้ประกอบวิชาชีพทางกฎหมายที่มีบทบาทสำคัญในการดำเนินคดีแทนตัวความ โดยทนายความจะทำหน้าที่ต่างๆ แทนตัวความทั้งสิ้น ทนายความจึงเป็นผู้รับผิดชอบต่อเกียรติยศ ชื่อเสียง ทรัพย์สิน สิทธิ หน้าที่ เสรีภาพของตัวความ การประกอบวิชาชีพทนายความจึงจำเป็นต้องมีการฝึกอบรมเป็นพิเศษก่อนเพื่อให้ได้ทนายความที่มีความรู้ความสามารถ และจริยธรรมเพียงพอต่อการปฏิบัติหน้าที่ การวิจัยนี้มีจุดมุ่งหมายเพื่อศึกษาเกี่ยวกับการจัดการฝึกอบรมเพื่อประกอบวิชาชีพทนายความในประเทศไทยในเรื่ององค์กรที่ให้การฝึกอบรมหลักสูตรการฝึกอบรม และวิธีการฝึกอบรม โดยศึกษาเปรียบเทียบกับการฝึกอบรมอัยการผู้ช่วย และผู้ช่วยผู้พิพากษา และการฝึกอบรมเพื่อประกอบวิชาชีพทนายความในประเทศอังกฤษ สหรัฐอเมริกา ฝรั่งเศส และญี่ปุ่น เพื่อหามาตรฐานการจัดการฝึกอบรมว่าเป็นไปตามมาตรฐานแห่งการประกอบวิชาชีพทางกฎหมายเพียงใด ผลการวิจัยพบว่าการฝึกอบรมยังไม่เป็นไปตามมาตรฐานการฝึกอบรมเพื่อประกอบวิชาชีพทางกฎหมายโดยองค์กรที่ให้การฝึกอบรมขาดบุคคลที่รับผิดชอบประจำหลักสูตรการฝึกอบรมยังไม่ครอบคลุมและเน้นหนักเนื้อหาที่จำเป็นต่อการนำไปใช้ ระยะเวลาการฝึกอบรมมีน้อยไป และวิธีการฝึกอบรมยังไม่มีประสิทธิภาพเพียงพอ ท้ายที่สุด ผู้เขียนได้สรุปและเสนอแนะแนวทางเกี่ยวกับองค์กร หลักสูตร และวิธีการฝึกอบรมเพื่อที่จะผลักดันให้มีการปรับปรุง พัฒนาให้การฝึกอบรมมีมาตรฐานยิ่งๆ ขึ้นไป เพื่อประโยชน์ในการประกอบวิชาชีพทนายความต่อไป

Other Abstract (Other language abstract of ETD)

The lawyer is a member of the legal profession who has important roles in adjudication in the court on behalf of his client. He must be responsible for his client's reputation, credit, property, right, duty and liberty. It is therefore necessary to train the lawyer to have special and adequate knowledge, skill and morale for his profession. The purpose of this research is to assess the administration of the training of the lawyer's profession in Thailand in the areas of organizers, courses and methods of the training, compared with those of the judge and prosecutor in Thailand and of the lawyer in England, United States of America, France and Japan, to find out how much it meets with standards of training and lawyer's profession. The result of the research has revealed many deficiencies due to the lack or permanent responsible personnel of the organizers, improper courses which do not cover and emphasize the contents needed for the functions, insufficiency of time and inefficient methods of the training. In conclusion, the writer has recommended guidelines for improvement of the organizers, courses and methods of the training of the lawyer's profession.
