Abstract

พระราชบัญญัติคุ้มครองผู้ประสบภัยจากรถ พ.ศ. 2535 ได้ตราขึ้นโดยมีวัตถุประสงค์ เพื่อให้การช่วยเหลือผู้ประสบภัยจากรถให้ได้รับการบรรเทาเยียวยาความเสียหายทันทีโดยไม่ต้องรอการพิสูจน์ความผิด แม้ว่ากฎหมายนี้จะมีเจตนารมณ์มุ่งที่จะเป็นหลักประกันในการชดใช้เยียวยา ความเสียหายให้แก่ประชาชนผู้ใช้รถใช้ถนน แต่กฎหมายดังกล่าวก็ยังมีปัญหาและข้อบกพร่องบางประการที่สมควรจะได้รับการปรับปรุงแก้ไข โดยวิทยานิพนธ์ได้พิจารณาถึงความเป็นธรรมของฝ่ายผู้เอาประกันภัย ฝ่ายผู้ประสบภัยจากรถ และฝ่ายบริษัทประกันภัย รวมทั้งบทบัญญัติแห่ง กฎหมาย ตลอดจนระเบียบและประกาศต่างๆ วิทยานิพนธ์ฉบับนี้ ผู้เขียนได้ศึกษาวิเคราะห์ปัญหาที่เกิดขึ้นจากการบังคับใช้กฎหมาย ดังกล่าว โดยปัญหาต่างๆเกิดจากบทบัญญัติของกฎหมาย นโยบายและการบริหารกฎหมายโดย กรมการประกันภัยเป็นหน่วยงานหลักที่มีหน้าที่กำกับดูแล ผู้เขียนได้เสนอแนวทางแก้ไขปัญหา ดังกล่าว ดังนี้ 1. การแก้ปัญหาในระยะสั้น โดยเสนอให้มีการแก้ปัญหาในเรื่องการกำหนดอัตรา เบี้ยประกันภัย การกำหนดจำนวนเงินค่าเสียหายเบื้องต้น การแก้ปัญหาเกี่ยวกับการชดใช้ค่าเสียหาย การแก้ปัญหาเกี่ยวกับการบังคับให้เจ้าของรถทำประกันภัยตามกฎหมายนี้ และการแก้ปัญหาเกี่ยวกับการใช้และการตีความกฎหมาย 2. การปรับปรุงกฎหมายให้เหมาะสมสำหรับการคุ้มครองผู้ประสบภัยจากรถ โดย เสนอให้มีการจัดตั้งองค์กรขึ้นเพื่อทำหน้าที่รับประกันภัยและจ่ายค่าเสียหายแก่ผู้ประสบภัยจากรถ และเสนอให้แก้ปัญหาความซ้ำซ้อนในการเยียวยาความเสียหายแก่ผู้ประสบภัยจากรถ

Other Abstract (Other language abstract of ETD)

The Protection for Motor Vehicle Accident Victims Act 1992 was enacted with the purpose of aiding the vehicle accident victims to get remedies right away without offence proved first. Although this law has the objective to secure the remedies for damage to any persons who use the roads. The said law still has problems and defects which should be solved. This thesis has considered the fairness of the insured, vehicle accident victims, and insurance companies including with laws, rules and notifications. This Thesis analyses the problems of enforcement of laws which are about the provision) of laws, policy and enforcement of laws by Insurance Department, superintendent organization. From those, I would like to propose the guidance to solve the said problem as follows : 1) In short-term period, the problems proposed to solve are about the rate of insurance fees, preliminary compensation, remedy for damage, compelling the vehicle owner to insure any accidents and construction of law. 2) Amendment of existing laws for appropriate protection to the vehicle accident victims, it is proposed to establish the organization functioning as an insurer and paying compensation to victims as well as to solve the overlapping problems on remedy for damage to the victims.
