Abstract

ปัญหาเกี่ยวกับความผิดใช้รถยนต์บรรทุกน้ำหนักเกินอัตรา ทำให้เกิดความเสียหายต่อรัฐในการซ่อมบำรุงรักษาทางหลวงถึงปีละประมาณ 13.824.000,000.- บาท จึงเป็นปัญหาสำคัญเกี่ยวกับเศรษฐกิจของประเทศไทยในปัจจุบัน การวิจัยพบว่ามาตรการทางกฎหมายเกี่ยวกับเรื่องนี้มีพระราชบัญญัติทางหลวง พ.ศ. 2535 พระราชบัญญัติการขนส่งทางบก พ.ศ. 2522 และประมวลกฎหมายอาญา แต่กฎหมายเหล่านี้มีผลควบคุมได้แต่เพียงปลายเหตุ คือ คนขับรถเท่านั้น ไม่มีผลไปถึงเจ้าของรถหรือผู้ประกอบการขนส่งอย่างแท้จริง และรัฐยังไม่ได้นำมาตรการทางปกครองและทางบริหารมาใช้ในการแก้ปัญหานี้ เพื่อการแก้ปัญหาเกี่ยวกับรถยนต์บรรทุกน้ำหนักเกินอัตรา สมควรแก้ไขมาตรการทางกฎหมาย ทั้ง 3 ฉบับดังกล่าวข้างต้น โดยบัญญัติฐานความผิดใช้บังคับต่อเจ้าของรถหรือผู้ประกอบการขนส่งขนใหม่ ให้เป็นอีกฐานหนึ่งต่างหากจากบทมาตรการที่ใช้กับคนขับรถ และบัญญัติให้รัฐมีอำนาจสั่งพักการใช้หรือเพิกถอนใบอนุญาตประกอบการขนส่งเป็นการชั่วคราวได้ และบัญญัติให้เจ้าของรถหรือผู้ประกอบการต้องชำระ ราคาค่ารถของกลางแทนโทษริบทรัพย์ในกรณีที่ไม่อาจริบรถยนต์บรรทุกของกลางได้ รวมทั้งมีบทบัญญัติให้เจ้าของหรือผู้ประกอบการขนส่งต้องรับผิดในทางแพ่งชดใช้ค่าเสียหายแก่รัฐซึ่งเรียกว่า "ค่าปรับทางการ ปกครอง" พร้อมกับการดำเนินคดีอาญาอีกส่วนหนึ่งด้วย ส่วนมาตรการทางการปกครองและทางบริหารนั้น รัฐควรตั้งกองทุนทางหลวงโดยใช้งบประมาณจากค่าปรับทางการปกครองมาดำเนินการจัดการและควบคุมดูแลเกี่ยวกับปัญหาการใช้รถบรรทุกน้ำหนักเกินอัตรา รวมทั้งจัดให้มีหน่วยงานของรัฐเข้าดำเนินการขนส่งแทน เจ้าของรถหรือผู้ประกอบการขนส่งที่ถูกสั่งพักหรือเพิกถอนใบอนุญาตในทันที เพื่อป้องกันความเสียหาย จากการหยุดชะงักของการขนส่งที่ต้องหยุดไปนั้น

Other Abstract (Other language abstract of ETD)

The government has been allocating the budget 13,824,000,000 Baht annually for the maintenance on national highways due to the result of national highways damage from the problem of overloading transportation system especially from overloaded freight trucks. Hence it is a crucial factor that plays an important role on Thailand’s economic problems. The research revealed that the legal measures against overloaded trucks provided under the National Highways Act BE 2535, Land Transportation Act BE 2522 and The Criminal Code of Thailand are only to enforce upon the truck drivers but not upon the Truck Entrepreneurs or Transportation Operators unless the government has decided to implement Administrative and Management measures to cope with these problems. Therefore it is appropriate to amend some existence legal measures which provided under the said three legislations in order to overwhelm the problems of overloading trucks by stipulation to be an offense to enforce upon the Truck Entrepreneurs or Transportation Operators apart from their truck drivers. Further nrore, the authority should be endorsed to suspend or terminate the Transportation Operator License or the compel the Truck Entrepreneurs or Transportation Operators to pay the actual cost of the overloaded truck confiscated instead of forfeiting the truck itself. It is also necessary to constitute the Truck Entrepreneurs or Transportation Operators liability for civil compensation to the damage called "Administrative Liability" apart from criminal prosecution. National Highways Fund should be established in order to implement the Administrative and Management measures to cope with the problem of overloading trucks, transportation duties instead of Truck Entrepreneurs or Transportation Operators whose licenses are revoked or terminated in order to prevent any impact that may occur from such legal measures implementation.
