Abstract

ปัญหาการค้าประเวณีชาย เป็นปัญหาที่ยังไม่ได้รับความสนใจจากสังคม จึงมีการเข้าสู่กระบวนการค้าประเวณี จากเด็กผู้ชาย และผู้ชายมากขึ้น มาตรการสำคัญที่ใช้แก้ปัญหาการค้าประเวณีชายมีปรากฏทั้งในมาตรการทางกฎหมาย และ ความร่วมมือระหว่างประเทศ ซึ่งสามารถจำแนกมาตรการต่อบุคคลได้ 2 กลุ่ม คือ เด็กชายค้าประเวณี และ ขายค้าประเวณี มาตรการทางกฎหมายระหว่างประเทศเน้นการป้องกัน และการปราบปราม การแสวงหาประโยชน์ทางเพศ จากการค้าประเวณีของผู้อื่น แต่จะไม่ลงโทษต่อผู้ค้าประเวณี ผลการศึกษาพบว่า กรณีของเด็กชายก็มีกฎหมายพิเศษเฉพาะ คือ อนุสัญญาว่าด้วยสิทธิเด็ก ค.ศ. 1989 ส่วนด้านความร่วมมือระหว่างประเทศ ก็มุ่งปฏิบัติการต่อกรณีของเด็กชายมากกว่าชายค้าประเวณี มาตรการทางกฎหมายภายในของประเทศไทยมีกฎหมายที่เกี่ยวข้องกับการค้าประเวณี หลายฉบับ เพื่อแก้ไขปัญหาการค้าประเวณีชาย แต่มีมาตรการบางประการสมควรปรับปรุงแก้ไข เพิ่มเติม ในประมวลกฎหมายอาญา เช่น การเอาผิดต่อผู้ซึ่งดำรงชีพอยู่ด้วยรายได้ จากชายค้าประเวณี การบังคับร่วมเพศทางเวจมรรค และทางปาก และมีการวางมาตรการฟื้นฟูเป็นการเฉพาะสำหรับเด็กชาย และชายค้าประเวณี นอกจากนี้แล้วควรมีการเปลี่ยนแปลงทัศนคติทางสังคมต่อการค้าประเวณีชายด้วย

Other Abstract (Other language abstract of ETD)

Public do not pay much attention to the male prostitute’s problem, so more men and boys come in the purpose of prostitution. Legal measures and international cooperations which are subjected to solve this problem, can be divided into boy prostitute’s problem and male prostitute’s problem. The international legal measures emphasize the prevention and the suppression of prostitution and also the exploitation in prostitution of others too. However, there are not any penal measures for prostitutes. The research reveals that there are many special measures for boys provide in the 1989 Child Rights Convention and almost international cooperation plans perform on boys cases more than men cases. There are many prostitution laws on Thai legal measures to solve this problem. The research reveals that Thai government should modify the penalty for person who live by male prostitute revenues. Sex offences which compelling to anal and oral sex should be enacted in Penal Code too. Furthermore, Thai government should set up the best and clear rehabilitative measures for boy and male prostitutes. Moreover, there should have to change the social concepts concerning male prostitution too.
