Abstract

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาผลสัมฤทธิ์การนำประมวลการจัดการเพื่อความปลอดภัยระหว่างประเทศ (ISM Code) ที่บังคับใช้ต่อกองเรือบรรทุกน้ำมันของไทยว่าสามารถบรรลุผลเพียงใด เนื่องจากมีการบังคับใช้เป็นระยะเวลาถึง 13 ปีมาแล้ว คือตั้งแต่ปี 2541-2555 โดยเรือน้ำมันของไทย ถือเป็นกองเรือพาณิชย์ที่มีจำนวนมาก และจำเป็นที่จะต้องปฏิบัติตามหลักของ ISM เนื่องจากถ้าเกิดอุบัติเหตุหรือความผิดพลาดขึ้น เรือน้ำมันจะทำให้เกิดมลภาวะอย่างมากต่อระบบนิเวศทางทะเลของไทย นั่นคือ การทำน้ำมันรั่วไหล ซึ่งอาจส่งผลต่อระบบนิเวศ สำหรับ วิธีการศึกษาวิจัยในเล่มนี้ใช้วิธีการคำนวณทางสถิติ โดยใช้โปรแกรมคอมพิวเตอร์สำเร็จรูปทางสถิติ SPSS เพื่อนำข้อมูลที่ได้มาประมวลผล และวิเคราะห์ค่าของข้อมูลเพื่อนำไปวิเคราะห์ผลสัมฤทธิ์ นอกจากนี้ยังมีการสัมภาษณ์บริษัทน้ำมันผู้ว่าจ้างเรือบรรทุกน้ำมัน และบริษัทประกันภัยเพื่อนำมาวิเคราะห์ในการวิจัยนี้ ผลการศึกษาพบว่า การบังคับใช้ ISM CODE บรรลุผล คือ การเกิดอุบัติเหตุทั้งเรือ สิ่งแวดล้อม ผู้ทำงานในเรือ และสินค้า ล้วนมีแนวโน้มอัตราการเกิดที่ลดลง และเมื่อบังคับใช้ ISM และด้านของบริษัทประกันภัยพบว่า ISM CODE มีส่วนสัมพันธ์กับการทำประกันภัยตัวเรืออย่างมาก เพราะถ้าไม่ได้ปฏิบัติตามหลัก ISM บริษัทประกันภัยจะไม่รับประกันภัยให้ ตลอดจน P& I Club เช่นกัน ISM CODE เป็นส่วนหนึ่งในการสร้างความน่าเชื่อถือของบริษัทเรือ ให้บริษัทประกันภัยเห็น ว่าเรือมีมาตรฐานสามารถเดินเรือในทะเลได้อย่างปลอดภัย แต่ไม่ได้หมายความว่าเรือจะมีความสมบูรณ์ทั้งหมด จำเป็นต้องมีองค์ประกอบอื่น นำมาพิจารณาประกอบกันด้วย ส่งผลให้ การได้รับ ISM CODE ในมุมมองของบริษัทประกันภัย จึงเป็นเพียงหลักฐานแสดงว่าเรือมีมาตรฐาน โดยมีส่วนในเรื่องการคิดเบี้ยประกันน้อยมากหรือแทบจะไม่มีผล

Other Abstract (Other language abstract of ETD)

The purpose of this research is to ascertain to what extent the potential of the enforcement of ISM Code for international safety, which has been applied to Thai oil tanker vessels for 13 years since 1997, has been realized. Owing to the sheer number of Thai commercial oil tanker vessels, it is imperative that they rigidly comply with the ISM protocols since their failure to follow them could engender severe pollution in the marine ecology. To establish the significance of the abovementioned potential, this research study obtained and analyzed both quantitative and qualitative data employing SPSS and interviews with the oil companies, the lessees of oil tanker vessels, and the insurance companies respectively. This study established that the enforcement of ISM Code has proved successful in reducing accidents stemming from vessels, environment, vessel personnel, and cargoes. With respect to insurance companies, it revealed that ISM code observance bears a significant correlation with the companies’ vessel insurance coverage, and thus may affect insurance premium calculations only to some extent or none. Hence, other determining factors need to be taken into account for vessel insurance.
