Abstract
การศึกษาบทบาทภาครัฐในการกำหนดนโยบายด้านอาชีพที่เป็นอันตรายต่อสาธารณะ ซึ่งงานวิจัยฉบับนี้เป็นงานวิจัยเชิงคุณภาพ (Qualitative Research) โดยมีวัตถุประสงค์เพื่อศึกษามาตรการทางกฎหมายในการจัดการด้านอาชีพที่เป็นอันตรายต่อสาธารณะ สาขาอาชีพช่างไฟฟ้า อิเล็กทรอนิกส์ และคอมพิวเตอร์ สาขาช่างไฟฟ้าภายในอาคาร และศึกษาผลกระทบการบังคับใช้กฎหมายดังกล่าว เพื่อวิเคราะห์นโยบายของรัฐในการจัดการด้านอาชีพที่เป็นอันตรายต่อสาธารณะ และข้อเสนอแนะในการดำเนินนโยบาย ผ่านแนวคิดวงจรนโยบายสาธารณะ โดยรวบรวมข้อมูลปฐมภูมิจากเอกสารและสื่อต่าง ๆ ที่เกี่ยวข้อง และสัมภาษณ์ผู้ให้ข้อมูลสำคัญ 3 กลุ่ม จำนวน 12 คน คือ ผู้บริหารระดับนโยบาย จำนวน 2 คน ผู้นำนโยบายไปปฏิบัติ จำนวน 2 คน และบุคคลที่อยู่ในอาชีพ จำนวน 8 คน ผลการวิจัยพบว่า แนวคิดของภาครัฐในการจัดการด้านอาชีพที่เป็นอันตรายต่อสาธารณะมีที่มาจาก 4 ประเด็นสำคัญ คือ 1) ความปลอดภัยสาธารณะ 2) ความล้มเหลวของตลาดผู้บริโภคจากการไม่มีข้อมูลเท่ากับผู้ให้บริการ 3) การรับรองความรู้ความสามารถในต่างประเทศของกลุ่มประเทศที่พัฒนาแล้ว และ 4) การส่งเสริมให้ผู้ประกอบอาชีพมีความรู้ความสามารถในการประกอบอาชีพอย่างแท้จริง และคุ้มครองความปลอดภัยสาธารณะจากการทำงาน ผู้ถูกสัมภาษณ์ได้ให้ข้อมูลถึงผลกระทบจากกระบวนการรับรองความรู้ความสามารถ (License) ของช่างไฟฟ้าภายในอาคาร พบว่าสามารถแยกแยะความแตกต่างของช่างไฟฟ้าทั่วไปและช่างไฟฟ้าที่มีมาตรฐานได้ และผู้รับบริการได้รับการบริการที่มีคุณภาพ แต่มีข้อจำกัดคือ การเข้าสู่อาชีพของประชาชนจะยากขึ้น ในแง่มุมของการประเมินผลสัมฤทธิ์ของนโยบาย พบว่า การเกิดอัคคีภัยจากไฟฟ้าลัดวงจร และการประสบอันตรายจากการถูกไฟฟ้าช็อตหลังจากการบังคับใช้กฎหมายดังกล่าว มีแนวโน้มคงตัวและลดลงไม่มากเท่าที่ควร จึงอาจกล่าวได้ว่านโยบายดังกล่าวไม่อาจแก้ไขปัญหาได้ตรงตามวัตถุประสงค์หลัก โดยภาครัฐใช้มาตรการบังคับเชิงกฎหมายส่งผลให้มีความเข้มงวดและขาดความยืดหยุ่น ซึ่งมีแนวโน้มที่ผู้ประกอบอาชีพจะกระทำความผิดและหลีกเลี่ยงกฎหมาย ดังนั้น จึงมีข้อเสนอแนะว่า ภาครัฐควรมีการสร้างมาตรการจูงใจทางเศรษฐศาสตร์ (Economic Incentive Approach) และ มาตรการใช้ความสมัครใจ (Voluntary Approach) มาใช้เป็นเครื่องมือเชิงนโยบายเพื่อให้เกิดผลดีในระยะยาวต่อไป
Other Abstract (Other language abstract of ETD)
The study examines the government sector'role in the policy formulation of dangerous works. A qualitative research with the aim of studying the legal measures in the management of occupations that are dangerous works, in the electric, electronic, and computer technology sector, building electrician , and to study the impact of the enforcement of such laws in order to analyze the government's policy in managing occupations that are dangerous to the public and suggestions for policy implementation through the concept of the public policy cycle by collecting primary data from relevant documents and media, and interviewing 12 people in 3 groups of key informants, namely 2 policy executives, 2 policy leaders, and 8 people in the profession. The results showed that the occupational management concept of public hazards stemmed from four key issues: 1) public safety, 2) Market Failure due to the lack of information as service providers, 3) Certification of knowledge and competencies abroad in developed countries, and 4) Promotion of professional knowledge and ability to truly pursue careers and protect public safety from work. In terms of evaluating the effectiveness of the policy, it was found that the occurrence of fires due to short circuits and statistics on the risk of electric shock after the enforcement of the law were observed. It is likely to be stable and not decrease as much as it should. Therefore, it can be said that such a policy cannot solve the problem in accordance with its main objectives. The government has taken compulsory legal measures, resulting in strictness and lack of flexibility.
